RESOLUTION NO. R-25-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARINO,
CALIFORNIA ACCEPTING AND AGREEING TO THE TERMS AND
CONDITIONS OF THE FY 2025-26 CANNABIS TAX FUND GRANT AND AMENDING THE FY 2025-26 BUDGET BY INCREASING THE REVENUE
ESTIMATES AND APPROPRIATIONS
WHEREAS, the City of San Marino is a municipal corporation duly organized and existing pursuant to the Constitution and the laws of the State of California (“City”); and WHEREAS, the Cannabis Tax Fund Grant, CTFGP, provides grant funds on a reimbursement basis for the purpose of assisting local communities in purchasing equipment and operations for impaired driving and prevention, which is administered by the California Highway Patrol; and
WHEREAS, the San Marino Police Department, SMPD, was awarded grant funds for equipment purchases, impaired driving enforcement, training, and educational presentations for community members; and
WHEREAS, the SMPD wishes to acquire authorized equipment and seek reimbursements pursuant to the subrecipient agreement between the SMPD and California Highway Patrol from the FY 25-26 CTFGP grant funds; and
WHEREAS, the budget for the City of San Marino for Fiscal Year 2025-26 was approved by the City Council on May 30, 2025; and
WHEREAS, the approved budget is in accordance with all applicable ordinances of the City and all applicable statutes of the State; and
WHEREAS, the reallocation of the appropriation between departmental activities may be made by the City Manager, while amendments (increase/decreases) to the budget shall be approved by adoption of a resolution of the City Council.
NOW, THEREFORE, BE IT RESOLVE, DETERMINE AND ORDERS AS
FOLLOWS:
SECTION 1 The City Council agrees to accept the grant award and abide by the terms and conditions of the Cannabis Tax Fund Grant and authorizes the City Manager or their designee to execute any and all agreements and documents necessary to accept and expend the grant funds.

SECTION 2. The SMPD is authorized to purchase equipment under the City’s purchasing policy for qualifying CTFGP projects and seek reimbursement from grant funds in accordance with the agreement.
SECTION 3. The Fiscal Year 2025-26 Police Operating Budget shall be amended as follows: Increase the revenue estimate and expenditure appropriations by $255,041.13.
SECTION 4. The City Clerk shall certify the passage and adoption of this Resolution.
