CITY OF SAN MARINO
ORDINANCE NO. O-25-1422

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN MARINO, CALIFORNIA, AMENDING SECTION 2.05.01

OF THE MUNICIPAL CODE TO RESTATE INDIVIDUALS
EXEMPT FROM THE CITY’S CLASSIFIED SERVICE
WHEREAS, the City’s current personnel rules and regulations define the Classified Service as “All employees of the City of San Marino except those specified as unclassified or as management personnel;”
WHEREAS, such definition is unintentionally vague and the City is clarifying the exemption from Classified Service in its newly drafted Personnel Rules and Regulations (“Rules”) as presented to the City Council in Resolution No. R-25-24 and WHEREAS, to formalize the City’s past and present practice as to which individuals are exempt from the Classified Service, the City is amending the Municipal Code as provided in Section 2 of this Ordinance.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MARINO DOES ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The City Council of the City finds and declares that the recitals set forth above are true and correct and are incorporated herein by this reference.

SECTION 2. Amendment of the City of San Marino Municipal Code Section 2.05.01.

Chapter II, Article 5, Section 2.05.01 is amended to add subsection “E” to read as follows; “E. Classified Service means the offices, positions and employments in the service of the City except the following: 1) Elected and appointed officers; 2) Members of appointed boards, commissions and committees; 3) Persons engaged under contract to supply expert, professional, or technical services for a definite period of time; 4) Volunteer personnel; 5) City Manager; 6) City Attorney; 7) Department Heads; and 8) Employees serving in hourly, temporary, provisional, parttime, or seasonal appointments.” SECTION 3. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. 2 SECTION 4. Publication. The City Clerk is directed to certify the adoption of this ordinance and cause it to be published in the manner required by law.
