Side Letter of Agreement
Between the San Marino Police Officers Association (“SMPOA”) and the City of San Marino (“City”)
WHEREAS, On May 31, 2024, the City Council adopted the July 1, 2024, to June 30, 2027, Memorandum of Understanding (“MOU”) with the San Marino Police Officers Association (“SMPOA”); and
WHEREAS, the Chief of Police and the Human Resources Director have met and conferred with the SMPOA concerning the proposed addition to Section 09.11 of the MOU; and WHEREAS, the SMPOA and the City agree to the following addition to the MOU:
Section 09.11. (E) GRANT FUNDED SATURATION PATROLS/DUI
CHECKPOINTS/EDUCATIONAL PRESENTATIONS. The City was awarded a grant from the California Highway Patrol (CHP) for the Cannabis Tax Fund Grant Program (CTFGP) on June 13, 2025 and is required by the grant to provide police personnel to work in the enforcement activities of such grant. All hours worked under this grant shall be paid at one and one-half (1.5) hours, when not regularly scheduled for duty. Effective September 28, 2025, this requirement is an exception to the city’s overtime provisions for purposes of this grant only.
In the event the City receives future grant monies that require the City to pay overtime, SMPOA and the City agree that police personnel will be paid at one and one-half (1.5) hours, when not regularly scheduled for duty for all hours worked under the grant.
Accordingly, the parties agree to the addition of Section 09.11. DEFINITIONS to the MOU.
