12. 4 West Santa Inez Avenue Condominiums – Reconsideration of Project Denial – As Amended Council Member Rodriguez recused himself from consideration of this item as he was on the Planning Commission at the time this was heard. Laura Richstone, Associate Planner, provided the staff presentation.
Jack Matthews, Matthews Architects, representing the applicant, provided a brief statement regarding the project. Council asked questions of the applicant.
Public Comment – Mary Diepenbrock thanked Council for the thoughtful original denial. Michael Diepenbrock stated concern with the developer of the project. Craig Jory stated concerns with public safety. Dylan Casey, CARLA, reviewed the history of the public process to approve this site. Eric Vallone stated concern with the speed of the project and parking. Lorna Shea stated she is a single-family homeowner directly affected by this project and is concerned with a heritage redwood tree. Brian McKague stated concern that the developer does not meet with the neighbors. Ilene McKague stated concern with safety issues. Martin Wiggins encouraged paying attention to housing. Jordan Grimes, Peninsula for Everyone, urged approval of the project, don’t incur additional legal fees. Gerry Wentworth appreciated the Council for paying attention to the project and noted concern with traffic. Jack Matthews responded with information regarding issues raised.
Council responded with comments noting the effort to make this a better project for the neighbors; however, their hands are tied by state law and expressed disappointment that a settlement could not take place to find common ground sooner. A denial would most certainly result in another lawsuit with low probability of prevailing. Council discussion ensued on parking proposal issues. Jack Matthews commented that the applicant would have no objection to amending the conditions of approval to add a condition regarding heritage tree health assessment.
Motion to Adopt a Resolution, to vacate the February 5, 2018 City Council action denying the proposed condominium project located at 4 West Santa Inez Avenue, and approve a:
1. Site Plan and Architectural Review for a new 15,322 square-foot, four-story 10-unit residential condominium building with an underground parking garage with an automated parking lift system;

4. Determination that the project qualifies for a Categorical Exemption from further environmental review under the California Environmental Quality Act (CEQA) Categorical Exemption, CEQA Class 32 Section 15332, “In-Fill Development Projects” based on the Findings and Conditions of Approval. Motion passed 4-0-1, with Rodriguez recused.
