FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: November 06, 2023
SUBJECT:
Citywide Street Reconstruction Phase 3 – Amendment
RECOMMENDATION:
Approve Amendment No. 7 to the agreement with Wilsey Ham for engineering services during construction in an amount not to exceed $21,000 for a new agreement total of $594,874; and authorize the Public Works Director to execute the amendment in substantially the form presented.
BACKGROUND:
In September 2021, the City Council approved an agreement with Wilsey Ham to provide design services for the Citywide Street Reconstruction Phase 3 Project (Project) in the amount of $354,000, with a contingency reserve in the amount of $41,000. Amendments No. 1, 2, and 3 to the agreement were issued for additional design services on the Project utilizing available contingency reserve, consistent with the authority granted by City Council. Currently, $40,874 of the contingency reserve has been expended with $126 of the contingency reserve remaining. City Council approved Amendments No. 4 (July 18, 2022) and No. 5 (June 20, 2023) to the agreement to provide additional engineering services during construction.
Amendment No. 6 was subsequently issued to correct the scope of work of Amendment No. 5 to reflect the actual scope of work intended for Amendment No. 5 as the incorrect scope of work was included in Amendment No. 5 due to a clerical error.
In June 2023, the Project’s contractor, Teichert Construction (Teichert), began reconstruction of all streets in the Project and was successful on seven of the nine streets. During the reconstruction effort on Hawthorne Drive and Guildford Avenue, several subgrade failures occurred due to unanticipated extreme soft soil/Bay mud conditions. During the operation, City staff stopped the operation in order to re-evaluate existing conditions and to develop new reconstruction designs for both Hawthorne Drive and Guildford Avenue to minimize further damage to the existing streets.
To complete the road reconstruction effort on Hawthorne Drive and Guildford Avenue, Wilsey Ham and its geotechnical subconsultant, Fugro, supported City staff in reviewing technical submittals, developing responses to Teichert’s Requests for Information (RFIs), and performing additional in-field geotechnical inspection services. Based on the above, staff recommends that a not-to-exceed amount of $21,000 be added to the agreement to cover the additional in-field geotechnical inspection services, for a total agreement amount of $594,874.
BUDGET IMPACT:
Sufficient funds are available in the Citywide Street Reconstruction Package 1/Citywide Street Reconstruction Phase 3 to award this agreement.
ENVIRONMENTAL DETERMINATION:
