AMENDMENT NO. 7 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND
WILSEY HAM FOR
PROFESSIONAL DESIGN SERVICES FOR STREET RECONSTRUCTION PHASE 3 (#467771-4600-0006-46250)
($354,000 [Original Amount], $24,980 [Amendment 1], $9,485 [Amendment 2], $6,409 [Amendment 3], $134,000 [Amendment 4], $45,000 [Amendment 5], $0 [Amendment 6], and $21,000 [Amendment 7])
WHEREAS, the City of San Mateo (“City”), a municipal corporation of the State of California, and Wilsey Ham, a corporation (“Consultant”), entered into an Agreement for Professional Design Services for Street Reconstruction Phase 3 (“Agreement”) on September 27, 2021; and WHEREAS, City and Consultant wish to amend the Agreement to modify scope and compensation for the services as described and to add Exhibit A-7.
NOW, THEREFORE, the parties agree as follows:
1. Section 1 “Scope of Services” of the Agreement is amended to read:
“The scope of service to be performed by Consultant under this agreement is as described in Exhibits A, A-1, A-2, A-3, A-4, A-6, and A-7 to this Agreement, attached and incorporated by reference.”
2. Section 5 “Payment” of the Agreement is amended to read:
“Payment shall be made by CITY only for services rendered and upon submission of a payment request upon completion and CITY approval of the work performed. In consideration for the full performance of the services set forth in Exhibits A, A-1, A-2, A- 3, A-4, A-6, and A-7, CITY agrees to pay CONSULTANT a fee, on a time and expenses reimbursement basis, in an amount not to exceed $594,874, pursuant to rates stated in Exhibits A, A-1, A-2, A-3, A-4, A-6, and A-7 and B to this Agreement, attached and incorporated by reference.”
3. The remaining terms of the Agreement remain in full force and effect. [SIGNATURE PAGE FOLLOWS]

SCOPE OF SERVICES
PROJECT DESCRIPTION
CONSULTANT is providing Engineering Services During Construction (ESDC) for the Citywide Street Reconstruction Project, Phase 3 which is part of the City’s Smooth Streets Program (SSP). During construction, differing site conditions were encountered and the City desires to expand the CONSULTANT’s scope of services to include additional field site visits.
SCOPE OF WORK
Task 1 – Construction Services
The following additional work is included in this task:
• Mix design submittal reviews
• Project correspondence
• City and design team coordination
• Design team meeting attendance
• Weekly construction coordination meeting attendance
• Three (3) ten-hour site visits, including travel time • Review field reports
• Review one additional submittal
• Provide administrative technical support for document preparation Deliverables: Review of construction materials submittals and responses to RFI’s in PDF format. Daily Field Reports provided by Fugro (geotechnical sub-consultant).
Assumptions and Exclusions
The following assumptions and exclusions were used in the preparation of this proposal:
1. Any design coordination meetings will be attended virtually (video or phone).
2. Items not included in the scope above are excluded.
3. If conditions encountered during construction differ from those anticipated, the estimated total number of hours on site may need to be adjusted during construction.
SCHEDULE
CONSULTANT will provide the scope of services described above on a mutually agreeable schedule.
