FROM: Alex Khojikian, City Manager
PREPARED BY: Police Department
MEETING DATE: January 02, 2024
SUBJECT:

Police Engagement and Collaboration with San Mateo-Foster City School District – Memorandum of Understanding RECOMMENDATION:

Approve a Memorandum of Understanding with the San Mateo-Foster City School District regarding engagement and collaboration with the San Mateo Police Department; and authorize the Chief of Police to execute the agreement in substantially the form presented.

BACKGROUND:

The San Mateo Police Department and the San Mateo-Foster City School District have a long history of working together to create positive and safe campuses. Of the District’s 21 schools, 16 are located in the City of San Mateo. The City and the District desire to memorialize the principles and guidelines which govern this relationship. The proposed Memorandum of Understanding (MOU) defines terms and conditions governing police engagement and collaboration on the District’s elementary and middle school campuses in the City of San Mateo, including applicable policy, roles, duties and planned school-related events and response to emergencies.

Under the MOU, the District is responsible for disciplining students for matters related to school activities or attendance.

A Police Officer may be called to respond to other matters including disposal of contraband such as illegal drugs, or when a student offense violates the law (arson, assault, drug sales). In the event the offense is eligible for diversion, the San Mateo Police Department will offer services through its robust juvenile diversion program which includes providing counseling, mentorship, social worker case management and mental health support. The District will be expected to call the police in the event of an emergency which requires a response which exceeds the scope of their resources or if there is a significant threat to human life or property.

The term of the MOU is for one year, and may be extended for one-year terms by written agreement. The District will conduct an annual student survey to maintain yearly data relative to feelings of safety on campus, and will develop a report summarizing the results, which will be shared with the Police Department. The District and staff from the Police Department will meet annually to review the terms of the MOU. If it is determined that modifications are necessary, those could be made and subsequently incorporated into an amended MOU.

BUDGET IMPACT:

There no budget impact as a result of approving this MOU.

ENVIRONMENTAL DETERMINATION:

This action is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)
