AMENDMENT NO. 2 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND
MBH ARCHITECTS, INC. FOR
DESIGN PROFESSIONAL SERVICES FOR
2ND & EL CAMINO GARAGE IMPROVEMENTS
($570,641 [Original Amount], $21,400 [Amendment 1], $266,222 [Amendment 2]) WHEREAS, the City of San Mateo (“City”), a municipal corporation of the State of California, and MBH Architects, Inc. (“Consultant”), entered into an Agreement for professional services for the 2nd & El Camino Garage Improvements (“Agreement”) on September 19, 2023; and WHEREAS, Amendment No. 1 in the amount of $21,400 was issued in November 2023 to develop a testing assessment program during the design and construction phases of the project; and WHEREAS, City and Consultant wish to amend the Agreement to modify the scope of work as described in Exhibit A-2, and to increase compensation for Consultant’s services..
NOW, THEREFORE, the parties agree as follows:
1. Section 1 “Scope of Services” of the Agreement is amended to read:
“The scope of service to be performed by Consultant under this agreement is as described in Exhibits A and A-2 to this Agreement, attached and incorporated by reference.”
2. Section 5 “Payment” of the Agreement is amended to read:
“Payment shall be made by CITY only for services rendered and upon submission of a payment request upon completion and CITY approval of the work performed. In consideration for the full performance of the services set forth in Exhibits A and A-2, CITY agrees to pay CONSULTANT a fee in an amount not to exceed $858,263.”
3. The remaining terms of the Agreement remain in full force and effect. [SIGNATURE PAGE FOLLOWS]
