FROM: Alex Khojikian, City Manager
PREPARED BY: City Manager’s Office
MEETING DATE: February 05, 2024
SUBJECT:
City Attorney Employment Agreement - Amendment
RECOMMENDATION:
Adopt a Resolution to amend the compensation for the City Attorney and authorize the Mayor to execute an amendment to his employment agreement.
BACKGROUND:
The City Council appointed the City Attorney on April 5, 2021, and last adjusted his compensation on October 3, 2022.
Following discussions between the City Attorney and Council member Amourence Lee, who was designated as the negotiator for the City, the attached amendment to the employment agreement is proposed for consideration by the City Council. The amendment would increase the City Attorney’s compensation in two stages, one immediately and another in one year, in amounts to be preliminarily determined by the Council in a closed session to be held on February 5, 2024.
Consistent with state law, the Council may only take action on the proposed amendment and compensation adjustment in open session.
The amendment would also provide for cost-of-living adjustments at the same time and amount as provided for department heads. Additionally, termination by the City Council could not occur within ninety days after an election where a new member or members are elected to the Council, and any termination would require payment of twelve months aggregate salary. These changes are consistent with the employment agreement between the City and the City Manager.
BUDGET IMPACT:
There are sufficient funds in the City Attorney’s office budget to accommodate a compensation adjustment.
ENVIRONMENTAL DETERMINATION:
This employment agreement amendment and compensation adjustment is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
