MEETING DATE: April 15, 2024
SUBJECT:
B Street Pedestrian Mall Improvements Project – Bid Rejection RECOMMENDATION:
Adopt a Resolution to reject all bids received for the B Street Pedestrian Mall Improvements Project; and authorize the Public Works Department to initiate a second Notice Inviting Bids.
BACKGROUND:
On May 17, 2021, City Council directed staff to establish a year-round Pedestrian Mall on the segment of B Street from 1st to 3rd Avenues (Pedestrian Mall). On October 4, 2021, Council adopted the Pedestrian Malls Ordinance, found in San Mateo Municipal Code (SMMC) Chapter 11.29. Thereafter, staff began work on the design phase of the Pedestrian Mall Improvement Project (Project), which includes enhancements such as street furnishings, planters, safety barriers (bollards) at the street ends, ADA access improvements, and bike racks.
The City entered into an agreement with Community Design + Architecture in January 2022 to design the above-described improvements to the Pedestrian Mall. By March 2024, Community Design + Architecture completed the design. The Project’s construction documents were prepared so that the bollards to be installed between 2nd and 3rd Avenues were included as part of the base bid (main contract). Meanwhile, the bollards to be installed between 1st and 2nd Avenues were included as “add alternate” bid items, meaning the City could choose to include the “add alternate” bid items at the time of contract award. The Engineer’s Estimate for the base bid was $980,000, and if the add alternative items were included, the total Engineer’s Estimate would be $1,347,000.
In accordance with Municipal Code section 3.60.030, a competitive public process was used to obtain bids for the Project.
A Notice Inviting Sealed Proposals was issued to advertise the Project on March 7, 2024. On the March 28, 2024 bid opening date, four bids were received:
Bidder Rank Contractor Base Bid Add. Alt. Bid Total Bid 1 BuildCorp Inc. $935,000 $144,000 $1,079,000
2 VNH Builders $980,700 $205,000 $1,185,700
3 Golden Bay Construction $1,326,834 $463,830 $1,790,664 4 Tennyson Electric $1,639,290 $712,150 $2,351,440
On April 1, 2024, staff presented an update on the Pedestrian Mall to City Council and requested direction on supporting a pilot program for the pedestrian mall between 1st and 2nd Avenues and on whether to install bollards or planter barriers on each block. City Council directed staff to move forward with planter barriers on both blocks of the pedestrian mall and not to install bollards at this time. Therefore, the Project as currently prepared cannot move forward as it includes bollards

between 2nd and 3rd Avenues as part of the main contract. Staff recommends rejecting all bids pursuant to SMMC section
3.60.040(a)(4) and readvertise the Project without the bollard scope.
Staff intends to start the re-advertisement of the revised Project by the end of this April. Staff will bring a future construction agreement award recommendation to City Council prior to the construction occurring in late summer/fall 2024. Staff will install the planter barriers through a separate procurement effort outside of the Project scope to facilitate their installation as soon as possible.
BUDGET IMPACT:
There is no budget impact for the rejection of bids.
ENVIRONMENTAL DETERMINATION:
This project is categorically exempt from CEQA as a project that has been disapproved. (CEQA Guidelines Section 15270.)
NOTICE PROVIDED
All meeting noticing requirements were met.
