PREPARED BY: Public Works Department
MEETING DATE: May 06, 2024
SUBJECT:
Downtown Parking Garage Safety Project – Agreement
RECOMMENDATION:
Approve an agreement with Golden Bay Construction, Inc. for the Downtown Parking Garage Safety Project in the amount of $380,439; establish a contingency reserve in the amount of $76,000; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders as allowed by the contract documents and within the contingency amount.
BACKGROUND:
The Downtown Parking Garage Safety Project (Project) includes the design of pedestrian safety improvements at the entrances and exits of the Central Parking Garage and Main Street Parking Garage. Pedestrian-friendly improvements include audible and visual pedestrian and vehicle warning devices, flexible delineators to provide physical separation between the drive aisle and walking paths, speed bumps, and updated pavement markings and traffic signs to address site- specific safety needs at each facility. The engineer’s estimate is $400,000.
The Project was advertised on March 5, 2024, and a total of three (3) bids were received and opened on April 2, 2024. The bids received are listed below in order of increasing bid amount.
Contractor Grand Total Bid Amount
BuildCorp, Inc. $326,700.00
Golden Bay Construction, Inc. $380,439.00
Tennyson Electric LLC. $589,125.00
BuildCorp, Inc., which submitted the lowest bid, was found nonresponsive because Bid Item No. 1 – Mobilization was listed at 12.2% of the total contract value, which is above the maximum 10% allowable set forth in the contract book. Therefore, BuildCorp, Inc. did not submit a bid that conformed to the contract book requirements and found nonresponsive. Staff then reviewed the second lowest bid, submitted by Golden Bay Construction, Inc. and determined that Golden Bay Construction, Inc. is the lowest responsible, responsive bidder, and recommends it be awarded the Agreement.
Given the limited information available on the existing electrical system in the two garages, there is a high likelihood that unforeseen issues will arise during construction. These unanticipated costs will need to be covered by the contingency reserve. Accordingly, staff recommends a 20% contingency to be established given the small size of the construction agreement and the possibility of significant unforeseen issues arising.

BUDGET IMPACT:
There are sufficient funds in the Downtown Parking Garage Ped Safety Project (#46F001) to fund this work in the amount of $380,439.00 and the contingency reserve of $76,000.00 for a total of $456,439.00.
ENVIRONMENTAL DETERMINATION:
This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
