SUBJECT:

Bermuda Drive Utility Relocation Project – Agreement
RECOMMENDATION:

Adopt a Resolution to approve an agreement with Pacific Gas & Electric for the Bermuda Drive Utility Relocation Project in the amount of $186,685.48; and authorize the Director of Public Works to execute the Agreement in substantially the form presented.

BACKGROUND:

On May 21, 2018, City Council approved the award of a professional services agreement with Biggs Cardosa Associates (BCA) for design and environmental documentation services for the Bermuda Drive Bridge Replacement Project. During design, BCA identified a utility conflict that will impede construction of the bridge replacement. On the north side of the bridge, existing overhead Pacific Gas & Electric (PG&E) electrical lines prohibit pile installation equipment to be raised and install the required bridge piles. These overhead lines need to be placed underground and out of the way of the pile equipment prior to the bridge construction work. The Bermuda Drive Utility Relocation Project (Project) is a subproject of the larger Bermuda Drive Bridge Replacement Project and will underground these electrical lines.

The Project is a joint effort by the City and PG&E. On December 4, 2023, City Council approved award of a construction agreement with St. Francis Electric to perform the City’s portion of the work that includes trenching and installing conduits and access vaults. As the serving utility, PG&E’s role includes engineering, inspection, and a portion of the construction (poles, risers, cables, and connections) needed to complete the undergrounding of electrical lines. As PG&E is the sole provider for electrical services, the City must contract with PG&E for successful completion of this work. A resolution is an appropriate way to document the contract with PG&E in lieu of competitive bidding for the project, as authorized by Municipal Code section 3.60.050(b).

The total cost of the PG&E work is $186,685.48, with the City having paid a $10,000 deposit during the design phase in September 2019. The balance due to PG&E is $176,685.48.

Staff therefore recommends approving the Agreement with PG&E to allow City staff to compensate PG&E for the remaining agreement amount of $176,685.48 to advance the Bermuda Drive Utility Relocation Project.

BUDGET IMPACT:

Sufficient funds are available for this PG&E work from the Bermuda Drive Bridge Replacement Project, Project No. 462250.

ENVIRONMENTAL DETERMINATION:

This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities,
