8 AMENDMENT NO. 5 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND
BOSCO OIL, INC. dba VALLEY OIL COMPANY FOR
DIESEL FUEL PROCUREMENT AND DELIVERY
This Amendment is made and entered into this day of ____________, by and between the CITY OF SAN MATEO (“CITY”), a municipal corporation existing under the laws of the State of California, and BOSCO OIL, INC. dba VALLEY OIL COMPANY. (“CONTRACTOR”).
WHEREAS, CITY and CONTRACTOR wish to amend the Agreement effective July 1, 2024, and exercise the fourth and final one-year agreement extension in an amount not to exceed $310,000, for a revised total agreement amount of $1,595,000.
NOW, THEREFORE, the parties agree as follows:
1. Section 4 – “Term” of the Agreement is amended to read:
“The services to be performed under this Agreement shall commence on July 1, 2020, and conclude on June 30, 2025.”
2. Section 5 – “Payment” of the Agreement is amended to read:
“Payment shall be made by CITY only for services rendered and upon submission of payment requested upon completion and CITY approval of the work performed. In consideration for the full performance of the services set forth in Exhibit A, CITY agrees to pay CONTRACTOR a fee in the amount not to exceed $1,435,000, pursuant to rates stated in Exhibit B, attached and incorporated by reference.”
3. The remaining terms of the Agreement remain in full force and effect. [SIGNATURE PAGE FOLLOWS]
