SUBJECT:
B Street Pedestrian Mall Improvements Project – Agreement RECOMMENDATION:
Approve an agreement with W.R. Forde Associates, Inc. for the B Street Pedestrian Mall Improvements Project in the amount of $534,866; establish a contingency reserve in the amount of $80,230; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders as allowed by the contract documents and within the contingency amount.
BACKGROUND:
On May 17, 2021, City Council directed staff to establish a year-round Pedestrian Mall on the segment of B Street from 1st to 3rd Avenues (Pedestrian Mall). On October 4, 2021, Council adopted the Pedestrian Malls Ordinance, found in San Mateo Municipal Code (SMMC) Chapter 11.29. This initiated the Pedestrian Mall Improvement Project (Project), which includes enhancements such as street furnishings, planters, safety barriers (bollards) at the street ends, ADA access improvements, and bike racks.
In January 2022, the City entered into an agreement with Community Design + Architecture for design of the Project, which was completed in March 2024. In accordance with Municipal Code section 3.60.030, a competitive public process was used to obtain bids for the construction of the Project. A Notice Inviting Sealed Proposals was issued to advertise the Project on March 7, 2024. On the March 28, 2024, the bid opening date, four bids were received.
On April 1, 2024, staff presented an update on the Pedestrian Mall to City Council and requested direction on supporting a pilot program for the pedestrian mall between 1st and 2nd Avenues and on whether to install bollards or planter barriers on each block. City Council directed staff to move forward with planter barriers on both blocks of the pedestrian mall and not to install bollards at this time. Therefore, the Project as previously designed could not move forward as it included bollards between 2nd and 3rd Avenues as part of the main contract. On April 15, 2024, City Council approved a resolution rejecting all bids and authorized re-advertisement of the Project without the bollard scope. A separate procurement effort is underway to install planter barriers outside the scope of this Project. Staff anticipates planter barriers will be installed by the end of June 2024.
The Project was re-advertised on April 16, 2024, with a reduced scope that includes the installation of two ADA parking stalls, landscaping and public seating improvements, striping modifications, and sign installations. The Engineer’s Estimate was $490,000. A total of four (4) bids were received and opened on May 9, 2024. The bids received are listed below in order of increasing bid amount.
CITY OF SAN MATEO
Contractor Grand Total Bid Amount
W.R. Forde Associates, Inc. $534,866.00
Andreini Bros., Inc. $552,732.00
Golden Bay Construction, Inc. $587,682.75
McGuire and Hester $732,250.00
Staff reviewed the lowest bid, submitted by W.R. Forde Associates, Inc. and determined that W.R. Forde Associates, Inc. is the lowest responsive, responsible bidder, and recommends it be awarded the agreement. In addition, staff recommend a 15% contingency to be established given the small size of the construction agreement.
BUDGET IMPACT:
There are sufficient funds in the Pedestrian Mall Construction Project (130004) to fund this work in the amount of $534,866 and the contingency reserve of $80,230 for a total of $615,096.
ENVIRONMENTAL DETERMINATION:
This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
