PREPARED BY: Public Works Department
MEETING DATE: June 17, 2024
SUBJECT:
Wastewater Treatment Plant Upgrade and Expansion Project Engineering Services – Amendment RECOMMENDATION:
Approve Amendment No. 2 to the agreement with Trussell Technologies, Inc. for additional engineering services for the Wastewater Treatment Plant Upgrade and Expansion Project and increase the agreement by $122,763, for a new not-to- exceed total agreement amount of $222,713; approve a contingency reserve in the amount of $12,000; and authorize the Public Works Director to execute the amendment in substantially the form presented and issue amendments within the contingency amount.
BACKGROUND:
One of the Wastewater Treatment Plant (WWTP) Upgrade and Expansion Project (Project) objectives includes the capability to produce Title 22 tertiary recycled water for non-potable reuse to incorporate the sustainability and water reclamation goals of both the City of Foster City and City of San Mateo City Councils.
Under a previous agreement, Trussell Technologies, Inc. (Trussell) prepared the Title 22 engineering report from the City to the Division of Drinking Water; developed the schematic design report for the approved Title 22 disinfection approach; and reviewed the final design of the upgrades developed by HDR Engineering, Inc., as the Engineer of Record for the Project to assure compliance with Title 22 non-potable reuse regulations. The final design for the Title 22 recycled water upgrades is currently under construction.
In August 2022, Trussell’s current agreement scoped Trussell to review the disinfection process control narrative submittals and evaluate various Title 22 scenarios for the WWTP. In March 2023, Amendment No. 1 to the Trussell agreement increased the scope to include developing standard operating procedures (SOPs) for Title 22 and Bay Discharge Disinfection to add to the WWTP electronic operations and maintenance manual; and providing operator training using the SOPs. The current agreement has a not-to-exceed total amount of $99,950.
The City needs Trussell to provide additional review of the disinfection process control narratives; startup assistance including input to the Project Startup and Commissioning Plan for the testing of the Title 22 disinfection system; onsite support during actual startup; and other as-needed support. Trussell submitted a final proposal for this scope in the amount of $122,763, which staff finds to be acceptable for the negotiated scope and level of effort.
Based on the above, staff recommends approval of Amendment No. 2 in the amount of $122,763 for the additional scope of work, described further in Attachment 1, and a contingency reserve of $12,000 to cover potential modifications to scope items that may be necessary to successfully complete the Project.

BUDGET IMPACT:
Currently, there are not sufficient funds available in the WWTP and Flow Management Upgrade and Expansion project (46t003). The overall budget committed to date of $542,927,000 as of the current Fiscal Year 2023-2024, has been fully encumbered. The remaining budget needed to complete the Project is part of the upcoming Fiscal Year 2024-2025 budget.
Upon approval and adoption of the Fiscal Year 2024-2025 budget as of July 1, 2024, there will be sufficient funds in the Project to fund the proposed Amendment No. 2 to Trussell’s agreement and establish the contingency reserve.
Staff is recommending approval of the proposed amendment at this time because a portion of the scope of work is required to be completed and invoiced in the current Fiscal Year 2023-2024 to meet the Project schedule.
ENVIRONMENTAL DETERMINATION:
The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). The PEIR was certified by City Council on June 6, 2016. In accordance with CEQA, the Final PEIR serves as the primary environmental compliance document for implementation of the Clean Water Program. The City prepared an Addendum to the Final PEIR that were approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2). This work is within the scope of the project evaluated in the PEIR and Addenda.
