Agenda Number: 13 Section Name: {{section.name}} Account Number: 10-4679 File ID: {{item.tracking_number}} TO: City Council
FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: June 17, 2024
SUBJECT:
Stormwater Fee for County Tax Rolls – Agreement
RECOMMENDATION:
Approve a Special Charge Agreement through fiscal year 2024-2025, with annual renewals, with the County of San Mateo to administer collection of the City’s Community Flood and Storm Protection Fee, at a projected rate of $1.42 per parcel; and authorize the City Manager to execute the agreement in substantially the form presented.
BACKGROUND:
The City operates and maintains a stormwater system, which provides vital services to safeguard neighborhoods from flooding and protects local waterways from pollution. The system consists of complex infrastructure including surface drains, underground pipes and conduits, pump stations, creeks and channels, and the Marina Lagoon. The City’s stormwater system requires improvements to address flood control capacity limitations and deficiencies related to aging infrastructure, enhanced operations and maintenance, and improvements to minimize pollutants in stormwater runoff as required by state and federal mandates.
On January 16, 2024, following passage of the Community Flood and Storm Protection Fee (Fee) by mail ballot, City Council adopted a resolution ordering the levy of the Fee for Fiscal Year 2024-25. The Fee, expected to generate approximately $4,000,000 in the first fiscal year, includes a maximum annual increase of 3% based on the Consumer Price Index (CPI), subject to City Council approval. To authorize fee collection by the County of San Mateo Controller’s Office on property tax rolls, the City is required to provide parcel fee information and to execute a Special Charge Agreement (Agreement) with the County. The Agreement lays out terms, conditions and fees, which is projected to be $1.42/parcel, or approximately $40,000 per year, to administer the fee. This Agreement shall automatically renew containing the same terms and conditions for each subsequent fiscal year thereafter unless either party notifies the other party of its intention not to renew.
Staff recommends approval of the Agreement and initiating fee collection for Fiscal Year 2024-25.
BUDGET IMPACT:
For Fiscal Year 2024-25, the compensation fee to the County is expected to be approximately $40,000. This amount will be deducted from the funds collected for the Stormwater Fee, which is projected to be approximately $4,000,000.
ENVIRONMENTAL DETERMINATION:
This action is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)
