RESOLUTION NO. __ (2024)
APPROVING CALTRANS’S COVER AGREEMENT FOR MANHOLE ADJUSTMENTS WHEREAS, the City of San Mateo (Owner) owns, operates, or maintains underground utility facilities in the State of California; and
WHEREAS, the State of California, acting by and through the Department of Transportation (Department) has identified 27 manhole utility conflicts within the project boundaries for the City of San Mateo; and
WHEREAS, the Department, in order to facilitate the planning, design and construction of the Department’s projects, manhole and valve cover adjustments need to be made; and WHEREAS, the Department is willing to assume control of the operation and cost of such adjustments to certain manhole and valve covers in order to facilitate the Department’s project needs from time to time as provided herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, HEREBY RESOLVES that:
1. This project is categorically exempt from CEQA as an “existing facility,” because implementation of the Cover Agreement consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use (CEQA Guidelines Section 15301).
2. The foregoing recitals are true and correct.
3. The Cover Agreement (“California Department of Transportation (Caltrans) Exhibit 13-EX-04 (New xx/2022)”) is hereby approved.
4. The Public Works Director is authorized to sign and execute said Cover Agreement in substantially the form attached to the staff report on behalf of the City.
