0 FIRST AMENDMENT TO AGREEMENT FOR USE AND LEASE AND
PROVISION OF SERVICES BETWEEN THE CITY OF SAN MATEO AND
SELF-HELP FOR THE ELDERLY
CENTRAL RECREATION CENTER
SAN MATEO, CALIFORNIA
This Amendment is made and entered into this __ day of June, 2024, by and between the CITY OF SAN MATEO, a municipal corporation existing under the laws of the State of California ("City"), and SELF-HELP FOR THE ELDERLY, a private non-profit corporation in the State of California (“Lessee”) (collectively, the “Parties”).
WHEREAS, on June 15, 2016, the City and Lessee entered into an “Agreement For Use and Lease and Provision of Services” (“Agreement”) for the Central Park Recreation Center located at 50 E. Fifth Avenue, San Mateo; and
WHEREAS, City and Lessee wish to amend the Agreement to extend the term by five (5) years from June 30, 2025, to June 30, 2030, and to provide for five (5) mutual one-year extension options.
NOW, THEREFORE, the Parties agree as follows:
1. Section C.2 of the Agreement is amended to read as follows:
TERM. The term of this Agreement shall be from July 1, 2016 to June 30, 2030 (“Term"). The Parties may extend the term of this Agreement for five (5) additional one-year periods, until June 30, 2035, by mutual written consent to be executed prior to the expiration of the then-current term. However, the parties agree to terminate this Agreement earlier if Lessee finds another location from which to provide programs and services to the San Mateo community. Lessee will notify City in writing specifying the date on which Lessee will vacate the Center. This Agreement will terminate on the date specified in Tenant’s notice.
2. All other terms and conditions of the Lease shall remain the same.
