CITY OF SAN MATEO
RESOLUTION __ (2024)

APPROVING SITE PLAN AND ARCHITECTURAL REVIEW (SPAR) FOR INTERIOR CHANGES, INCLUDING TO MODIFY PLANNING APPLICATION 1997-033 CONDITIONS OF APPROVAL #57 AND #69 FOR LIVE-WORK UNITS IN AN EXISTING MIXED-USE BUILDING LOCATED AT 1528 SOUTH EL CAMINO REAL (PA-2023-057, 1528 S. EL CAMINO REAL, ZONING MAP AMENDMENT + SPAR) WHEREAS, on May 11, 1998, the City Council approved Planning Application (PA) 1997-033 for a Site Plan and Architectural Review (SPAR) for a mixed-use building with ten (10) live-work units and landscaping and a Parcel Map to merge parcels zoned as R3 and C2-1/R4 located at 1528 South El Camino Real (APN 034-413- 290), resulting in a split-zoned lot facing El Camino Real at the front and Jasmine Street at the rear, and made findings to permit height and intensity bonuses for the residential and commercial mixed-use project (“Project”) with amenities beyond City requirements; and
WHEREAS, approval of PA-1997-033 included architectural plans and Conditions of Approval #57 and #69 which imposed restrictions on 10 live-work units, including that the residential components of the live-work units shall be no less than 540 square feet or 25% of the unit floor area, whichever larger; and WHEREAS, the site is currently developed with a four-story, 60,790 square-foot mixed-use building with a subterranean parking garage; and
WHEREAS, in recent years the live-work units have not included residential components as the primary use, and instead have been used as offices as documented through a code enforcement case; and WHEREAS, on September 7, 2023, to correct these on-site violations, the applicant (The Kastrop Group, Inc.) submitted a planning application (PA-2023-057) to modify the PA-1997-033 Conditions of Approval to allow interior changes including to replace 10 live-work units with 10 independent residential units with commercial spaces where no exterior changes are proposed, and to rezone of the western portion of the property from R3 to C2-1/R-4 which would facilitate the proposed project; and WHEREAS, on March 18, 2024, the City Council, as the legislative body of the City of San Mateo, adopted the City of San Mateo’s General Plan 2040, which included redesignating the land use for the entire site to Mixed-Use Medium II, which provides for medium-density mixed-use buildings that provide a variety of commercial, office, and/or residential uses within the same site or building and neighborhood; and WHEREAS, the C2-1 zoning designation allows a combination of regional and community commercial uses including offices, and the /R4 overlay zoning designation supports residential uses as part of a mixed-use development, and therefore the zoning map amendment from R3 to C2-1/R4 would be more compatible with the subject property’s current General Plan land use designation in that it would align the existing development with the zoning designation and ensure that subsequent new development and uses at the subject property would be subject to zoning district’s development standards for a mixed-use development; and WHEREAS, the original Conditions of Approval #57 and #69 would be removed and replaced by a new condition requiring the site to maintain a minimum of 10 independent residential units for the life of the project, unless modified by a City-approved entitlement, and the residential units shall be the same sizes or larger and provide the same or greater number of bedrooms as the PA-2023-057 approved plans; and

WHEREAS, due to the Project’s proposed interior modifications, PA-2023-057 incorporates new and revised conditions of approval, including some that supersede conditions outlined in PA-1997-033; and

WHEREAS, on April 23, 2024, the Planning Commission held a duly noticed public hearing, at which time the Commission received and considered written and oral evidence, and by a vote of 5-0 recommended that the City Council approve the zoning map amendment and SPAR, including the modification s to PA-1997-033 Conditions of Approval, subject to the Findings for Approval and PA-2023-057 Conditions of Approval.

NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, HEREBY FINDS AND RESOLVES THAT:

1. The City Council finds on the basis of the whole record before it that there is no substantial evidence that the Project will have a significant effect on the environment. In accordance with CEQA Section 15183 - Projects Consistent with a Community Plan or Zoning , the interior changes including the modifications to the conditions of approval and zoning map amendment from R3 to C2 -1/R4 are exempt from further environmental review because the project is consistent with the development density established by the City’s General Plan 2040 policies for which an Environmental Impact Report (EIR) was certified on March 18, 2024. In addition, there are no proposed addition or exterior modification to the existing structures; there are no project specific effects which are peculiar to the project or its site; there are no project specific impacts which the General Plan Update EIR failed to analyze as significant effects; there are no potentially significant off- site and cumulative impacts which the G eneral Plan EIR failed to evaluate; and there is no substantial new information which results in more severe impacts than anticipated by the general plan EIR.

Furthermore, any future
development of the site would be subject to a project specific environmental assessment consistent with the CEQA statues and guidelines in effect at that time. The project conforms to applicable goals and policies in the City’s General Plan.

a. In conformance with Policy LU 3.1, Housing Diversity, the project promotes a diverse neighborhood by providing different types and sizes of homes for individuals, families, and households of various income levels.
b. In conformance with Policy LU 5.1, Housing on El Camino Real , t he project encourages independent residential uses along El Camino Real as part of this mixed -use development which diversifies the commercial character of the neighborhood.

2. The 1528 S. El Camino Real Site Plan Architectural Review (PA-2023-057) is approved based upon the findings and conditions of approval included in Exhibit A , attached hereto and incorporated by reference.

3. The Site Plan and Architectural Review (Municipal Code Section 27.08.030) application for modifications to Planning Application #1997 -033 conditions of approval and associated interior modifications to a mixed-use building are approved based on the following findings:
a. The existing structures, site plan, and landscaping are in scale and harmonious with the mixed- use character of the neighborhood in that the existing building, which was approved by the City Council in 1998 does not propose any exterior modifications; b. The development will not be detrimental to the harmonious and orderly growth of the City in that the project maintains ten residential units, along with other commercial and office uses,

which is consistent with the General Plan policies and goals which promote a mixed -use neighborhood with housing;
c. The development will not impair the desirability of investment or occupation in the vicinity, and otherwise is in the best interests of the public health, safety, or welfare in that the project consists of improvements to an existing mixed -use building with commercial, office, and residential uses in an area well- served by public transit , and would allow for 10 functional residential units;
d. The development meets all applicable standards as adopted by the Planning Commission and City Council, conforms with the General Plan, and will correct any violations of the zoning ordinance, building code, or other municipal codes that exist on the site; and e. The development will not adversely affect matters regarding police protection, crime prevention, and security in that the buildings and paths of travel will be required to conform to the City’s current Security Ordinance through conditions of approval.
