SUBJECT:
Wastewater Treatment Plant Upgrade and Expansion Project Easement – Amendment RECOMMENDATION:
Adopt a Resolution to approve an amendment to the Easement Deed and Agreement between the City of San Mateo and All American Self Storage, L.P. modifying the Public Utility Easement for the Wastewater Treatment Plant site; and authorize the Mayor to execute the amendment in substantially the form presented.
BACKGROUND:
The Wastewater Treatment Plant (WWTP) Upgrade and Expansion Project ("Project") consists of several new treatment process facilities and a new administration building currently under construction on the previously undeveloped parcel on Detroit Drive, as well as upgrades and enhancements to the existing WWTP facilities. All American Self Storage, L.P. (AAS) is a self-storage business located directly across Detroit Drive from both the existing and new WWTP Project site. The Project obtained multiple easements from AAS for the placement of wastewater infrastructure and for construction access.
AAS previously granted the City a permanent and exclusive public utility easement under the Easement Deed and Agreement (“Agreement”) executed on January 23, 2021, and recorded in the County of San Mateo Recorder’s Office on February 12, 2021, as Document Number 2021-024495. The Agreement provided the City the rights to construct, operate, and maintain permanent subsurface sanitary sewer transmission pipelines and appurtenances in that portion of the easement area. Pursuant to its rights under the Agreement, the City’s Contractor has completed construction of multiple subsurface sewer pipelines.
The purpose of the proposed Amendment is to accommodate additional ancillary pipelines and other public utilities, such as an irrigation system and communications fiber optics within the existing public utilities easement. These additional utilities are to be installed in the easement area to facilitate operation and maintenance of the City facilities and surrounding infrastructure. The City and AAS have agreed on the proposed amendment, at no additional cost to the City.
Staff recommends approval of the Amendment.
BUDGET IMPACT:
All costs associated with the execution and recordation of the Amended Easement Deed and Agreement are included in the WWTP Upgrade and Expansion (46t003) Project budget.
ENVIRONMENTAL DETERMINATION:
CITY OF SAN MATEO
The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). The City prepared an Addendum to the Final PEIR that were approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2).
