Agenda Number: 6 Section Name: {{section.name}} Account Number: File ID: {{item.tracking_number}} TO: City Council
FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: August 19, 2024
SUBJECT:
731 and 771 Crystal Springs Road Access Easements – Acceptance RECOMMENDATION:
Adopt Resolutions to accept two Grants of Easement on 731 Crystal Springs Road and 771 Crystal Springs Road; and authorize the City Manager to execute the Grants of Easement in substantially the form presented.
BACKGROUND:
A Public Utility Easement (PUE) for City of San Mateo storm drain infrastructure currently exists between Columbia Drive and Crystal Springs Road. The PUE is 10 feet wide and existing City storm drain infrastructure extends outside of the PUE and into the southern corner of the property located at 731 Crystal Springs Road and northern corner of the property located at 771 Crystal Springs Road. The Columbia/Crystal Springs Storm Drain Improvements Project (Project) will remove the existing storm drain infrastructure, which currently comprises an open channel on 731 Crystal Springs Road and underground pipe and manhole on 771 Crystal Springs Road and replace the existing open channel and underground pipe and manhole with a new underground pipe, a cleanout, and manhole. Construction is expected to occur in Summer or Fall 2024.
Due to existing site constraints, Public Works seeks to adjust the existing alignment for new storm drain construction. The location of the new underground pipe, cleanout, and manhole require the property owners at 731 Crystal Springs Road and 771 Crystal Springs Road to grant easements to the City of San Mateo to account for the storm drain infrastructure which extends outside of the current PUE.
The property owner at 731 Crystal Springs Road agrees to grant an easement to the City of San Mateo on, across, and over the southern corner of their property not covered by the PUE for construction and maintenance of the storm drain infrastructure.
The property owner of 771 Crystal Springs Road agrees to grant an access easement to the City of San Mateo on, across, and over the northern corner of their property not covered by the PUE for construction and maintenance of the storm drain infrastructure.
The Grants of Easement include language that allows the Grantor to relocate the easements if an alternate point of access is identified and agreed upon by the Grantor and City of San Mateo. The City's contracted Licensed Surveyor prepared a plat and legal description for the agreements. The easements allow construction and operations and maintenance staff the proper rights to construct and maintain the storm drain infrastructure and prevent flooding issues. Staff recommends Council adopt the attached Resolutions accepting the proposed access easements with associated plat and legal descriptions and authorizing execution by the City Manager.
