FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: August 19, 2024
SUBJECT:

Central Recreation Center Roof Improvements – Agreement RECOMMENDATION:

Adopt a Resolution approving an alternative purchasing procedure to award an agreement with McGinnis Chen Associates, Inc. for design professional services in an amount not to exceed $93,025; establish a contingency reserve of $10,000; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue amendments within the contingency amount.

BACKGROUND:

The Central Recreation Center at Central Park has served the community for over sixty-five years. The building’s roof structure consists of flat gravel and sloped wood shingle. The wood shingle has been subjected to decades of moisture and leaks which have been an on-going issue at the facility for years. Currently, there are water penetrations in various locations.

In 2023, the City engaged McGinnis Chen Associates, Inc. (MCA) to perform a Citywide roof assessment. The final report identified this specific location as a potential health and safety risk due to the compromised roof structure and recommends immediate action. Other facilities identified with having similar issues include the Beresford Recreation Center, Martin Luther King Recreation Center and City Hall.

Due to the immediate need for improvements to the roof at the Central Recreation Center, City staff considered an alternate purchasing procedure whereby the City requested a proposal from an engineering firm that the City prequalified based on recent, satisfactory, and similar services received at other City facilities such as the Police Department and the Transit Center where MCA was tasked with the assessment, investigation, destructive testing, and design improvements for remediation. The scope of services for the Central Recreation Center Roof Improvements project includes investigation, testing, design, documentation, bidding support, and construction administration.

An alternative purchasing method may be utilized in accordance with Municipal Code section 3.60.070(h)(3), which states “The following procedures may be used only upon a finding by the City Council prior to or concurrent with the award of contract that the procedures are in the best interests of the City for the particular contract…” The deterioration of the roof at the Central Recreation Center presents a high risk for biological growth which affects the air quality and threatens public health. Initiating the design for the improvements at the earliest time, through the alternate purchasing method, is recommended to be in the best interests of the City and its constituents. Based on MCA’s familiarity of the City’s Facilities through the Citywide Roof Assessment project, procuring MCA will result in a timely deliverable which allows the City to obtain building permits and award the construction in the Spring of 2025. construction duration is expected to take six months and can only occur during dry weather, so it is vital that the design documents are complete, and permits are obtained prior to that time.

MCA submitted a proposal on June 24, 2024, that includes design tasks to improve the roof at the Central Recreation Center. Based on their proposal, award of the design professional services agreement to MCA is recommended.

BUDGET IMPACT:

There is sufficient funding in the Central Recreation Center: Roof Replacement (46F042) project budget to fund this agreement and the proposed contingency reserve.

ENVIRONMENTAL DETERMINATION:

This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
