SUBJECT:

City Wide In-Person Safety Training – Amendment
RECOMMENDATION:

Approve Amendment No. 2 to the professional consultant services agreement with Du-All Safety, LLC, for in-person safety training of City employees; increase the agreement by $240,000, for a new not-to-exceed total amount of $360,000; approve a contingency reserve increase of $40,000, for a new contingency total of $52,000; extend the term of the agreement through August 31, 2026; and authorize the Public Works Director to execute the amendment in substantially the form presented and execute amendments within the contingency amount, including no-cost time extensions.

BACKGROUND:

In order to meet California Occupational Safety and Health Administration requirements, the Public Works Department (PW) must establish and maintain a department safety training program. The City has been using Du-All for safety training since 2011.

In 2022, Public Works and Parks and Recreation jointly developed and issued a Request for Proposals (RFP) to revamp the safety training program to provide more in-house training capacity through City-owned computer-based training modules and Standard Operating Procedures. This would limit in-person safety trainings to those required by statute or that are most appropriate to be done in an in-person environment. The City selected DKF Solutions Group (DKF) as the most responsive and qualified consultant to support the City's training program transition and executed an agreement for the one-time development of computer-based training modules and Standard Operating Procedures. DKF provided the computer-based trainings but subcontracted the live in-person training to Du-All Safety, LLC (Du-All). It was anticipated that DKF would provide services for three years; however, last year the supplier informed City staff that due to workload considerations, they would be unable to continue providing safety program assistance.

Given that DKF was no longer able to provide the safety program assistance, staff recommended an agreement directly with Du-All for the in-person safety training services. An agreement was approved by City Council on November 23, 2023, and executed on February 6, 2024. Amendment No. 1 of the agreement extended the term of the agreement to August 31, 2024.

Du-All’s scope of work is considered professional services since it consists of specialized training services similar to those previously provided to the City and has a team of instructors that can conduct both classroom and “hands on” training, as required. Staff and trainees have been very satisfied with the services provided by Du-All.

Based on the above, staff recommends approval of Amendment No. 2 with Du-All Safety, LLC.
