WASTEWATER TREATMENT PLANT UPGRADE AND EXPANSION PROJECT
FIRST AMENDMENT TO EASEMENT DEED AND AGREEMENT (PUBLIC UTILITY EASEMENT) WHEREAS, Wastewater Treatment Plant Upgrade and Expansion Project ("WWTP Project") consists of several new treatment process facilities and a new administration building currently under construction on the previously undeveloped parcel on Detroit Drive, as well as upgrades and enhancements to the existing WWTP facilities.; and
WHEREAS, All American Self Storage, L.P. (AAS) is a self-storage business located directly across Detroit Drive from both the existing and new WWTP Project site; and WHEREAS, the WWTP Project obtained multiple easements from AAS for the placement of wastewater infrastructure and for construction access; and
WHEREAS, AAS granted to the City a permanent and exclusive public utility easement (PUE) under the Easement Deed and Agreement (“Agreement”) executed on January 23, 2021, and recorded in the County of San Mateo Recorder’s Office on February 12, 2021, as Document Number 2021-024495; and WHEREAS, the Agreement provided the City the rights to construct, operate, and maintain, permanent subsurface sanitary sewer transmission pipelines and appurtenances in that portion of the PUE area; and WHEREAS, the proposed amendment to the Agreement is to accommodate additional, ancillary pipelines, and other public utilities to be installed in the said PUE area to facilitate the operation and maintenance of the City facilities and surrounding infrastructure; and WHEREAS, the City and AAS have agreed on the proposed amendment to the Agreement, at no additional cost to the City; and
WHEREAS, the City of San Mateo authorizes the Mayor to execute any and all documents required to effectuate this amendment to the PUE required for this project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, HEREBY RESOLVES that:
1. The City of San Mateo approves the First Amendment to the Easement Deed and Agreement between the City of San Mateo and All American Self Storage, L.P.; and authorizes the Mayor to execute any and all documents required to effectuate this amendment to the PUE required for this project.
2. The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). Council on June 6, 1 0

6 2016, certified the PEIR. In accordance with CEQA, the Final PEIR serves as the primary environmental compliance document for the implementation of the Clean Water Program. The City prepared Addenda to the Final PEIR that was approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2).
This work is within the scope of the Project evaluated in the PEIR and Addendum.
