1 AMENDMENT NO. 1 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND
CONFLUENCE RESTORATION, INC. FOR
PLANT MAINTENANCE SERVICES
FOR THE NORTH SHOREVIEW FLOOD IMPROVEMENT PROJECT
MITIGATION PLANTING MAINTENANCE
($20,000 [Original Amount] / $87,000 [Amendment No. 1]) This Amendment is made and entered into this day of _____________, by and between the CITY OF SAN MATEO (“CITY”), a municipal corporation existing under the laws of the State of California ("CITY"), and CONFLUENCE RESTORATION, INC. ("CONTRACTOR").
WHEREAS, the CITY and CONTRACTOR entered into an Agreement for plant maintenance services (“Agreement”) on August 14, 2023; and
WHEREAS, CITY and CONTRACTOR wish to amend the Agreement effective ________________ to expand scope, extend the term, and increase compensation in the amount of $87,000, for a new total compensation not to exceed $107,000.
NOW, THEREFORE, the Parties agree as follows:
1. Section 1, “Scope of Services,” of the Agreement is amended to include:
“Year 1 tasks include supplemental planting of 815 seasonal wetland plug species and seeding of 5,750 SF of seasonal wetland seed mix in the Fall/Winter of 2024.
Year 2-4 tasks, starting July 1, 2024, include monthly site inspections, bimonthly watering during the dry-season, and weed control as needed.
Year 5 tasks include quarterly weed control and site inspections.”
2. Section 4, “Term,” of the Agreement is amended to read:
“The services to be performed under this Agreement shall commence July 28, 2023 and be completed on December 31, 2028.”
3. Section 5, “Payment,” of the Agreement is amended to read:
“Payment shall be made by CITY only for services rendered and upon submission of a payment request upon completion and CITY approval of the work performed. In consideration for the full performance of the services set forth in Section 1, CITY agrees to pay CONTRACTOR in an amount not-to-exceed $107,000.” Contract Amendment Page 2 of 3
