Subject: Deny Request - Small Cell Wireless at 16 Baldwin Avenue, San Mateo - WC-20240000241 Dear Mayor Lisa Diaz Nash, Deputy Mayor Rob Newsom, Councilmembers Hedges, Loraine and Lee, City Manager Alex Khojikian, Director of Public Works Matt Fabry and City Engineers Jay Yu and Jason Hallare, I am writing to strongly urge you to DENY the small cell wireless application number WC-20240000241 with an application date of 10/23/2024 that would be located at 16 Baldwin Avenue in San Mateo.

I am a parent at the Episcopal Day School of St. Matthew located at 16 Baldwin Avenue in San Mateo, where my children and over 300 students attend school daily. Within twenty feet of where this transmitter would be boated is the primary play space for children during recess, physical education, afterschool sports activities, and community gatherings. This Ication is NOT an appropriate place for a small cell wireless tower given the radiation risks that these devices pose to sensitive populations, such as the children at our school.

The updated policy ordinance that the City of San Mateo recently enactedregarding wireless services as of November 18, 2024, precludes locations such as the one at 16 Baldwin Avenue, by classifying homes, schools, and daycares as "restricted sites" with a 300-foot radius setback required from those sensitive sites. Under this new ordinance, the installaion of a small cell wireless device at 16 Baldwin Avenue would be prohibited today. Please deny this application considering the City's own acknowledgement of risks these devices pose to sensitive populations such as the children at our school.

Thank you for your time and consideration.

Sincerely.

has bies an are ation nd 202400024 to the appal Day Sate of 023/04 located for a malie virales ansmite ve instited at ed that here Avenue in San Mateo.

I am writing to urge you NOT to approve this application. The small cell unit would be installed within 20 feet of where my and hundreds other kids play every day. This outdoor area is the primary play space for children during recess, physcal education, afterschool sports activities, and community gatherings. This location is clearly NOT an appropriate place for a small cell wireless tower given the radiation risks that these devices pose to sensitive populations, such as the children at our school.

I appreciate that your government has acknowledged these risks through the poicy ordinance enacted on November 18, 2024 that prohibits installation of vireless transmitters within 300 feet of homes, schools, and daycares. Unfortunately, though, the application filed for 16 Baldwin Avenue was submitted three weeks before your policy went into effect. I sincerely hope that you would recognize this and deny the application considering the City's own acknowledgement of risks these devices pose to sensitive populations such as the children at our sciool.

My sincere thanks for your time and consideration. I am very happy to speak with you directly as well if that would help.

Best regards,
Andy Collins

Katherine,
Thank you for the response. While I appreciate that this application may fall within the FCC's safety standards, if there are no safety issues, then why would there be a need for the city to adopt a new ordinance that prohibits transmittersfrom residential and school areas? Respectfully, I do not believe the owner of this transmitter should be able to slip their application in just weeks ahead of the ordinance going into effect. If the city doesn't want new transmitters going up in sensitive areas, then none should go up, regardless of application date. I also ind it troubling that of all the locations that could be chosen, this company picked a spot so very close to a school playground. That seems reckless and veryunfair to the hundreds of kids who will be playing every day within 20 feet of this device. The people who are impacted should have a say on this matter.

Best,
Andy

Good evening interested residents,
This email is in response to feedback we received from multiple parents at the Episcopal Day School of St. Matthew. Thank you for sharing your concerns regarding the Small Wireless Facility (SWF) application at 16 Baldvin Avenue in San Mateo.

The application under review was submitted on Oct. 22, 2024—which was prior to the City Council's new ordinance adopted on Nov. 18, 2024 and thus subject to the prior Code and Design Standards that were in effect prior to this new ordinance. The standards that were in effect prior to Nov. 18, 2024 did not include restricted sites around residential areas and schools, and these requirements are therefore not enforceable for the 16 Baldwin Avenue application.

It is important to note that the current application has been found to be compliant with the Federal Communications Commission (FCC)-defined radiofrequency (RF) emissions limits. This compliance with FCC safety limits has been verified by the City's RF expert consultant, OSC Engineering.

Wireless facilities like this must meet certain FCC criteria, including exposing people to RF radiation exceeding applicable FCC safety standards. The City is federally preempted from regulating RF emissions other than for compliance with FCC limits. The adopted ordinance sets rules for small wireless facilities in the public right-of-way, and reflects the City's interest in keeping SWFs out of residential neighborhoods and away from schools when feasible.

The City's Public Works team and consultants are thoroughly reviewing thisapplication and will have a decision on or before Dec. 20, 2024.

Thanks Katherine and Jason. Hope you had a nice Thanksgiving.

With all due respect, while I appreciate that this application may fall within the FCC's safety standards, if there are no safety issues, then why has the City now adopted a new ordinance that prohibits transmitters from resilential and school areas, and specifically labels these sites as "sensitive." In my eyes, if this area is now deemed "sensitive" by the City under the new ordinance as of November 18th, it would have been equally sensitive back in October when this application was submitted. If he city doesn't want new transmitters going up in sensitive areas, then none should go up, regardless of application date, That is certainly withinyour jurisdiction. I also find it troubling that of all the locations that could be chosen, this company picked a spot so very close to a school playground. That seems reckless and very unfair to the hundreds of kids who will be playing every day within 20 feet of this device. The people who are impacted should have a say on this matter. There are many other sites in San Mateo that this transmitter could be installed that are away from senstive areas, and it seems this should simply be a matter of the City working with this company to find another more suitable location that is in compliarce with the new ordinance.

Thank you for your consideration.
