1 AMENDMENT NO. 2 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND HARRIS & ASSOCIATES, INC.
FOR ON-CALL CONSULTING SERVICES FOR ANNUAL SANITARY SEWER REHABILITATION
PROJECTS
($1,000,000 [Original Amount] / $400,000 [Amendment No. 1] / $0 [Amendment No. 2])
WHEREAS, the City of San Mateo (“CITY”), a municipal corporation of the State of California, and Harris & Associates, Inc. (“CONSULTANT”), entered into an Agreement for professional services (“Agreement”) on March 23, 2020; and WHEREAS, on February 25, 2022, the CITY and CONSULTANT executed Amendment No. 1, extending the term of the Agreement by two years and increasing the Agreement by $400,000, for a total Agreement in the amount of $1,400,000; and WHEREAS, CITY and CONSULTANT, wish to amend the Agreement to extend the term of this Agreement for one additional year.
NOW, THEREFORE, the parties agree as follows:
1. Section 4, “Term,” of the Agreement is amended to read:
“This Agreement shall be valid for a duration of six (6) years.
The services to be performed under this Agreement shall commence and be completed as set forth in Exhibit B, Project Schedule.
CONSULTANT shall not be responsible for delays caused by circumstances beyond its reasonable sole control.”
2. The remaining terms of the Agreement remain in full force and effect. [SIGNATURE PAGE FOLLOWS]
