Agenda Number: 16 Section Name: {{section.name}} Account Number: 14-4682 File ID: {{item.tracking_number}} TO: City Council
FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: April 07, 2025
SUBJECT:
Mobile Parking Revenue Collection Amendment – Approval
RECOMMENDATION:
Approve Amendment No. 1 to the agreement with PayByPhone US, Inc. for mobile parking payment services in the amount of $65,000 for a new agreement total of $150,000; and authorize the Public Works Director to execute the amendment in substantially the form presented.
BACKGROUND:
The PayByPhone system was first implemented in 2016 and allows patrons the ability to pay for public parking via their smartphone. Due to turnover, staff inadvertently allowed the prior agreement with PayByPhone to expire at the end of July 2024. In March 2025, to continue mobile payment services and expedite payment for services since expiration of the agreement, the City executed a new two-year agreement with PayByPhone US, Inc. (PayByPhone) in the amount of $85,000.
The agreement was intended to pay for outstanding PayByPhone invoices from August to November 2024 as well as unforeseen miscellaneous fees (i.e., new location numbers, sign fabrication). However, due to a lengthy negotiation process, the City incurred additional outstanding invoices from December 2024 through March 2025. There are insufficient funds in the existing agreement to pay for the outstanding invoices from December 2024 to March 2025.
City staff recommends increasing the agreement amount by $65,000 for a new total agreement amount of $150,000. The added funds will be used to pay the outstanding invoices from December 2024 to March 2025 and unforeseen miscellaneous fees. The new agreement includes a revised process under which PayByPhone receives all parking revenue remitted via mobile payments. PayByPhone then remits to the City the balance of parking revenue minus PayByPhone's costs, thereby eliminating the monthly process of invoicing the City for payment of fees. As such, the proposed amendment provides sufficient funding to cover all outstanding invoices and fees, and additional funding is not required for the remainder of the agreement timeframe. Staff recommends Council approve proposed Amendment No. 1.
BUDGET IMPACT:
There are sufficient funds from the Transportation operating budget to fund this amendment.
ENVIRONMENTAL DETERMINATION:
This City Council action is not a project subject to CEQA, because it can be seen with certainty that there is no possibility that approval of an amendment to the Agreement with PaybyPhone to provide mobile parking payment services may have a significant effect on the environment. (CEQA Guidelines Section 15061(b)(3).)
