CITY OF SAN MATEO
RESOLUTION NO. ____ (2025)
APPROVING AN ALTERNATIVE PURCHASING PROCEDURE TO APPROVE A PURCHASE
CONTRACT FOR THE PURCHASE OF AN ABOVEGROUND FUEL TANK AND FUELING EQUIPMENT WITH PETROLEUM MARKETING EQUIPMENT IN THE TOTAL AMOUNT OF $125,606.39 WHEREAS, the State Water Resources Control Board requires that the two 10,000-gallon underground storage tanks (USTs) located at the City’s Corporation Yard be taken out of operation by December 31, 2025 to reduce the chances of soil contamination as a result of not having secondary containment; and WHEREAS, the On-Site Fueling Station Replacement and Canopy Addition Project (Project) proposes to replace the USTs with an aboveground storage fuel tank (AST) and associated fueling appurtenances; and WHEREAS, due to the urgency of this project and the anticipated several-month lead time of the AST and fueling equipment, City Council is being asked to approve the purchase of the tank and fueling equipment using an alternative purchasing procedure per Municipal Code Section 3.60.070(h)(3); and WHEREAS, Municipal Code Section 3.60.070(h)(3) provides that the City may use any purchasing procedures approved by the City Council if the Council makes a finding concurrent with the award that the procedures are in the best interest of the City for that particular agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, RESOLVES that:
1. This City Council action is categorically exempt from CEQA review as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
2. In accordance with Municipal Code Section 3.60.070(h)(3), the purchase of an above ground fuel tank and fueling equipment from Petroleum Marketing Equipment $125,606.39 separate of the construction agreement and based on competitive quotes is in the City’s best interest due to:
a. The state’s upcoming deadline of December 31, 2025 to take the existing USTs out of operation by December 31, 2025.
b. The extensive procurement lead times for the aboveground fuel tank and fuel equipment. c. The potential hardship on the City in fueling gas-powered vehicles and equipment if the new aboveground fuel tank and fueling equipment is not in operation by December 31, 2025.
3. The purchase contract of an aboveground fuel tank and fueling equipment with Petroleum Marketing Equipment in an amount of $125,606.39 is approved.
4. A contingency amount of $13,000 is approved.
5. The Public Works Director is authorized to execute the purchase contract in substantially the form presented on behalf of the City and issue change orders within the contingency amount.
