RESOLUTION NO. ____ (2025)

APPROVING AN ALTERNATIVE PURCHASING PROCEDURE FOR THE AGRREMENT WITH BRAND ENERGY SERVICES OF CALIFORNIA, INC. FOR THE DIGESTER 2 COATING PROJECT ($406,881.35)
WHEREAS, the Clean Water Program (CWP) Annual Major Components (AMC) Projects includes several capital improvement projects that are currently under development or under construction and are intended to upgrade or rehabilitate aging infrastructure in the City’s sewer collection system and Wastewater Treatment Plant (WWTP); and
WHEREAS, repairs to Digester 2 are part of these projects, which included removal of the mixer in Digester 2 for repairs; and
WHEREAS, the mixer for Digester 2 is currently offline and has been repaired off-site and ready to be reinstalled; and
WHEREAS, an initial condition assessment of Digester 2 was recently completed and revealed the draft tube and interior of Digester 2 needs to be re-coated prior to reinstalling the mixer; and WHEREAS, the WWTP is currently operating with only Digester 1, which is the older of the two Digesters, and there is concern about its current condition; and WHEREAS, operating one Digester only at the WWTP incurs additional costs; and WHEREAS, it is most cost effective to re-coat the interior of the digester and draft tube while Digester 2 is currently offline prior to reinstallation of the mixer and while the required specialized scaffolding is in place; and
WHEREAS, in April 2025, the City obtained three proposals from three local coating vendors rather than a bidding procedure in order to meet the timelines required for digester repairs and mixer reinstallation; and WHEREAS, City staff evaluated the quotes and determined Brand Energy Services of California, Inc. had the lowest quote and demonstrated experience with the type of work required; and WHEREAS, San Mateo Municipal Code Section 3.60.030 generally provides that purchases and contracts within City Council’s award authority require a bidding procedure; and WHEREAS, San Mateo Municipal Code Section 3.60.070(h)(3) provides that the City may use purchasing procedures approved by the City Council if the City Council makes a finding concurrent with the award for the agreement that the procedures are in the best interest of the City for the particular contract; and WHEREAS, based on the above, City staff recommends approval of an agreement with Brand Energy Services of California, Inc. for the Digester 2 Coating Project based on an evaluation of direct quotes.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, FINDS and RESOLVES that:

1. This Council action is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.) 1 2

0 2. Pursuant to San Mateo Municipal Code Section 3.60.070 (h)(3), approval of an agreement with Brand Energy Services of California, Inc. through an evaluation of direct quotes rather than a bidding procedure is in the City’s best interests because:
a) The Wastewater Treatment plant is currently operating with only Digester 1, which causes an increase in the cost of off haul per month by $26,000; b) Specialized scaffolding has been installed in Digester 2 for the condition assessment of Digester 2, and is needed during the re-coating of the Digester. c) The cost of renting the scaffolding is $15,000 per month; d) The mixer for Digester 2 has been repaired and is ready to be reinstalled; e) It is cost effective to re-coat the interior of Digester 2 prior to reinstalling the mixer; and f) Obtaining and evaluating direct quotes rather than a bidding procedure avoids costs and delay time normally associated with the development of highly technical bid specifications and time associated with bidding procedures while assuring that competitive prices are received.

3. The agreement with Brand Energy Services of California, Inc. to conduct Wastewater Treatment Plant Digester 2 Coatings in an amount not to exceed $406,881.35, with a $82,000 contingency reserve, is approved.

4. The Public Works Director is authorized to execute the agreement in substantially the form presented and approve any necessary change orders within the approved contingency amount.
