Marina Branch Public Library Restoration Project – Agreements RECOMMENDATION:
Approve an agreement with DL Falk Construction, Inc. for construction of the Marina Branch Public Library Restoration Project in the amount of $5,405,000; establish a contingency reserve for said agreement in the amount of $540,500; approve an agreement with Consor PMCM, Inc. for construction management services for the Marina Branch Public Library Restoration Project in the amount of $824,900; and authorize the Public Works Director to execute the agreements in substantially the form presented, issue change orders as allowed by the contract documents, and approve change orders within the construction agreement contingency amount.
BACKGROUND:
The Marina Branch Public Library Restoration Project (Project) will implement critical improvements, including foundation stabilization with new helical piles and grade beams, re-leveling of the existing foundation and structures, and compliance with Americans with Disabilities Act (ADA) requirements. Additional improvements encompass the replacement of entrance and egress ramps, site drainage improvements, deck replacement, lighting (external and indoor), flooring, roof replacement, heating, ventilation, and air conditioning (HVAC) equipment, plumbing improvements, fire sprinkler and alarm systems, and electrical system replacement.
The City entered into an agreement with Siegel & Strain Architects in July 2023 to design the Project and the design was completed in April 2025. The design includes two (2) additive bid items: (A) to fabricate and install a bookworm sculpture, and; (B) to fully remove and replace stucco along the exterior of the building. The Architect’s estimate for the base bid and additive bid items was $5,000,000.
Construction Agreement
In accordance with Municipal Code section 3.60.030, a competitive public process was used to obtain bids for the Project.
A Notice Inviting Sealed Proposals was issued to advertise the Project on April 25, 2025. On the May 22, 2025, bid opening date, three (3) bids were received.

CITY OF SAN MATEO
Staff reviewed the lowest bid submitted by DL Falk Construction, Inc., and determined that DL Falk Construction, Inc. is the lowest responsive, responsible bidder. Staff recommends City Council award the Agreement to DL Falk Construction, Inc. inclusive of the scopes of Additive Bid Items A and B. In addition, staff recommends a 10 percent contingency be established given potential unforeseen site conditions, the complexity of performing a retrofit project, and caution that will need to be exercised due to the project’s proximity to Seal Slough.
Construction is anticipated to commence in the summer of 2025 with completion in spring of 2027, resulting in an approximately 16-month temporary closure of the library. Staff are implementing outreach to inform the community and library patrons.
Construction Management Agreement
The City issued a Request for Proposals (RFP) for Construction Management, Inspection, and Hazardous Materials Compliance Services for the Project on February 26, 2025. On the April 4, 2025, deadline to submit proposals, one (1) proposal was received from Consor PMCM, Inc. (Consor). Staff reviewed the proposal, interviewed Consor, and determined the firm’s proposal to be satisfactory based on the Project team’s experience with similar projects and comprehensive project approach to meet the goals of the RFP.
Consor will be providing construction management and inspection services that include oversight of the contractor, review of construction documents such as submittals, change orders, progress payments and requests for information, adherence to schedule, and coordination with City and design staff. They will also monitor the contractor’s hazardous materials handling and verify compliance with CEQA measures that stem from the project’s proximity to Seal Slough and potential sensitive habitats.
Staff recommends entering into a contract with Consor to perform the construction management services for this Project for an amount not to exceed $824,900.
BUDGET IMPACT:
Currently, sufficient funds are not available in the Marina Library Structural Improvements (665100) project account budget to approve the construction agreement; however, the remaining funding needs to sufficiently cover the full cost of the agreement and recommended contingency have been requested through the 5-year Capital Improvement Program budget development process and will be available under the Marina Library Structural Improvements (665100) project pending approval and adoption of the Fiscal Year 2025-26 budget. Sufficient funds are available in the project account to approve the construction management contract with Consor.
ENVIRONMENTAL DETERMINATION:
This approval of these Agreements is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
