FROM: Alex Khojikian, City Manager
PREPARED BY: Parks and Recreation Department
MEETING DATE: August 18, 2025
SUBJECT:
Recreation Services Agreement — Contingency Reserve Increase RECOMMENDATION:
Approve a contingency reserve increase in the amount of $30,000 for the Recreation Service Agreement with Bay Area Educational Theater Company, 501(c)(3) for youth summer camps, revising the original contingency reserve from $25,000 to $55,000; and authorize the Director of Parks and Recreation to issue change orders within the contingency amount.
BACKGROUND:
On May 20, 2024 City Council approved a Resolution and a Recreation Service Agreement with Bay Area Educational Theater Company, 501(c)(3) for the provision of youth theater summer camps. The services performed under the agreement commenced on June 16, 2024 and will be completed on August 31, 2025. The approved Resolution was for $254,000 for services rendered during the term of the agreement and authorized the Director of Parks and Recreation to execute the agreement and approve change orders up to $25,000. The amount was established based on previous year’s registration numbers. Due to the increase in program registration from 167 enrollments in 2024 to 202 enrollments in 2025, the contingency amount needs to be amended in order to allow Bay Area Educational Theater Company to be compensated for the remainder of this fiscal year.
The city compensates the Bay Area Educational Theater Company 70 percent of total course revenue, after deducting administrative surcharges from gross revenues along with 100 percent of material fees collected at the time of registration.
BUDGET IMPACT:
Course registration fees paid by participants cover all compensation to the contractor.
ENVIRONMENTAL DETERMINATION:
This agreement is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)
