SUBJECT:

San Mateo Safety Management Association Memorandum of Understanding — Amendment RECOMMENDATION:

Adopt a Resolution to amend the San Mateo Safety Management Association (SMSMA) Memorandum of Understanding (MOU) to delete floating holidays from Section 12.0 - Holidays and provide clarification to ensure compliance with the California Public Employees’ Retirement System (CalPERS).

BACKGROUND:

The City was recently notified by the California Public Employees’ Retirement System (CalPERS) that the holiday-in-lieu compensation for floating holidays is not pensionable. BUDGET IMPACT:

The recommended amendments for the San Mateo Safety Management Association (SMSMA) Memorandum of Understanding (MOU) have no fiscal impact.

This Side Letter of Agreement is not a project subject to CEQA, because it is a government fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. (CEQA Guidelines Section 15378(b)(4).)
