PREPARED BY: Public Works Department
MEETING DATE: November 17, 2025
SUBJECT:
477 9th Avenue Reversion to Acreage Final Map and Subdivision Improvement — Agreement RECOMMENDATION:
Adopt a Resolution to approve the 477 9th Avenue reversion to acreage final map and accept the dedication for a sidewalk easement as shown on the final map; approve the subdivision improvement agreement with SMDT Partners, LLC; and authorize the Public Works Director to execute the agreement in substantially the form presented.
BACKGROUND:
The Planning Commission approved the application for a Special Use Permit, Site Plan and Architectural Review, and Site Development Planning Application for 477 9th Avenue (PA22-047) on December 12, 2023. The project consists of a 5-story mixed-use building, consisting of 29,207 square-feet of office space and 120 residential apartment units on a 1.6-acre site.
Since the site was previously subdivided into 13 commercial condominiums and the new project did not include any condominium units, a reversion to acreage final map was required as a Condition of Approval to eliminate the condominium purpose from the site. The project was also required to dedicate a sidewalk easement as a Condition of Approval to accommodate a wider public sidewalk along the entire project frontage.
In July 2024, the developer filed the reversion to acreage final map with the City in compliance with the Conditions of Approval, Subdivision Map Act, and San Mateo Municipal Code Section 26. The final map includes a dedication for a sidewalk easement for public use. The final map was reviewed for accuracy and completeness by the City’s survey and mapping consultant, CSG Consultants. A copy of the final map is included as Attachment 2.
The developer is requesting the final map be approved and recorded prior to the completion of the project’s right-of-way improvements. Government Code Section 66462(a) requires the developer to enter into a subdivision improvement agreement with the City to ensure completion of the work. The associated improvement plans were prepared by the developer’s engineer and are compliant with the City standards, and to the satisfaction of the Public Works Director. The subdivision improvement agreement is included as Attachment 3.
BUDGET IMPACT:
Approval of the final map and subdivision improvement agreement will have no budgetary impact.
ENVIRONMENTAL DETERMINATION:
This action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) On December 12, 2023, the Planning Commission determined that the underlying development proposal was exempt pursuant to CEQA Guidelines Section 15332 (Class 32 – In-Fill Development Projects).
