MEETING DATE: November 17, 2025
SUBJECT:
2nd and El Camino Real Sidewalk Repair Project — Agreement RECOMMENDATION:
Approve an agreement with Imperial Construction & Engineering, Inc. in the amount of $128,525.00; establish a contingency reserve in the amount of $20,000.00; and authorize the Public Works Director to execute the agreement in substantially the form presented and issue change orders as allowed by the contract documents and within the contingency amount.
BACKGROUND:
The 2nd and El Camino Real Sidewalk Repair Project (Project) will perform sidewalk repairs along 2nd Avenue and El Camino Real along the frontage of the City-owned 2nd and El Camino Parking Garage located at 8 2nd Avenue. The Project consists of the replacement of concrete sidewalk, curb, and gutter, and removal of trees, tree roots, and asphalt roadway repairs to address damages in three locations due to tree roots as well as the replacement of a damaged sanitary sewer lateral for the City-owned garage.
The City advertised the Project on August 28, 2025, and received and opened 11 bids on September 25, 2025. The bids received are listed below in order of increasing bid amount. The Engineer’s Estimate was $140,000.
Contractor Base Bid
Modernscapes Innovations $120,285.00
Imperial Construction and Engineering $128,525.00
FBD Vanguard $132,470.00
WR Forde Associates $132,835.00
Mission Constructors $133,656.25
Starline Construction $134,054.50
Spektren Engineering $134,104.26
CF Contracting, Inc. $136,800.00
JJR Construction $148,318.75
Golden Bay Construction $150,107.00
Sposeto Engineering $152,362.50
After review of bid documents, staff determined that Modernscapes Innovations was the lowest bidder. However, Modernscapes Innovations‘ bid was found nonresponsive after being unable to meet the City’s insurance requirements and California Air Resources Board’s In-Use Off-Road Diesel-Fueled Fleets Regulations (DOORS). Therefore, staff
CITY OF SAN MATEO
recommends Imperial Construction & Engineering be awarded this construction agreement as the lowest responsive, responsible bidder. In addition, staff recommends a construction contingency of 15% be established to address any potential unforeseen conditions. Construction is anticipated for early 2026.
BUDGET IMPACT:
There are sufficient funds available in the Parking Facility Structural Repairs Project (Project No. 46F025) and the Citywide Pavement Program (Project No. 469997) project budgets to award this agreement and establish the contingency reserve.
ENVIRONMENTAL DETERMINATION:
This project is categorically exempt from CEQA as an “existing facility,” because it consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. (CEQA Guidelines Section 15301.)
