Housing Element Implementation, Tenant Protection Policies — Ordinance Adoptions RECOMMENDATION:
Adopt an Ordinance to add Chapter 10.100 to Title 10 of the San Mateo Municipal Code; and adopt an Ordinance amending Chapter 7.50 of the San Mateo Municipal Code; and find the Ordinances exempt from further environmental review pursuant to California Environmental Quality Act (CEQA) Section 15061(b)(3).
BACKGROUND:
On November 17, 2025, the City Council introduced two Ordinances: one to add Chapter 10.100 to Title 10 of the San Mateo Municipal Code, and another to amend Chapter 7.50 of the Municipal Code. The introduction included an exemption from further environmental review pursuant to CEQA Section 15061(b)(3). Adoption of these Ordinances is important to ensure consistency within the Municipal Code, support effective implementation of City policies, and provide clear regulatory guidance for the community and staff. The ordinance adding Chapter 10.100 also corrects the compliance date for providing a Notice of Tenant Rights to February 1, 2026, rather than February 1, 2025.
If adopted, these Ordinances will become effective 30 days after their adoption.
BUDGET IMPACT:
Code Amendments to implement the Housing Element are fully funded in the Community Development Department’s annual operating budget, utilizing the Advanced Planning Fund (Fund 225), and does not impact the City’s General Fund.
ENVIRONMENTAL DETERMINATION:
This Ordinance Adoptions is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
