PREPARED BY: Police Department
MEETING DATE: December 01, 2025
SUBJECT:

Digital Evidence Software Subscription — Agreement
RECOMMENDATION:

Approve an agreement with Cellebrite Inc., for a subscription to Cellebrite InsEYEts Software for a term concluding August 1, 2028, in the cumulative amount of $322,595.75; approve a contingency reserve of $50,000 and authorize the Chief of Police to issue change orders within that reserve; and authorize the Chief of Police to execute the agreement in substantially the form presented.

BACKGROUND:

In 2023 the City Council approved a multi-year agreement with Cellebrite Inc., for their Premium software which enables police investigators to access digital evidence from iOS/Apple and Android devices. These devices contain significant data used for criminal investigations and prosecutions. The continued use of this software is a critical component to effectively investigating cases.

Personal technology devices such as smart phones are commonly used to facilitate crime or are used in the commission of a crime. Common crimes include homicide, stalking, sexual assault, harassing calls or texts, hate crimes, extortion, blackmail, fraud, sex trafficking, revenge porn, bullying, domestic violence, burglary/theft, robbery, drug sales/ manufacturing and many others. Phones contain valuable information used in criminal prosecutions (pictures, texts, phone records, documents, GPS data). Phones may also contain exculpatory information that may clear a person from suspicion in a criminal case. Cell phone data simply cannot be ignored in modern policing and investigative work, not only because phones contain a wealth of information, but also because jurors expect to have physical data that links individuals to criminal activity.

Cellebrite has indicated plans to sunset the current Premium software program next year and will be discontinuing any further advancements and support. They are now offering a new software program called “Cellebrite InsEYEts.” This new technology is more robust and efficient, including an added Artificial Intelligence feature that will help detectives locate evidence faster during forensic extractions. For these reasons, staff has negotiated a new agreement with Cellebrite for access to the InsEYEts software program.

Cellebrite is the leader in this industry, and their software allows access to the widest range of devices. The Police Department believes retaining the ability to access digital evidence is crucial. The cost for the new InsEYEts software package is $137,952.55 annually and reflects a discount due to the long-term relationship. The payment due in the current year has also been discounted to $46,960.65 in recognition of annual subscription costs which have already been paid under the prior agreement. The new agreement reflects the scope of services and payment rates to encompass the new InsEYEts program.

BUDGET IMPACT:

The cost associated with the first year for the InsEYEts software program can be accommodated in the Police Department’s FY2025-26 operating budget. Future costs will be incorporated into the 2026-28 Business Plan.

ENVIRONMENTAL DETERMINATION:

This action is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.)
