PREPARED BY: Public Works Department
MEETING DATE: December 01, 2025
SUBJECT:

Bay Meadows MU3, Final Map & Subdivision Improvement — Agreement RECOMMENDATION:

Adopt a Resolution to approve the Bay Meadows MU3 final map and accept the dedication for a public access easement as shown on the final map; approve the subdivision improvement agreement with Bay Meadows MU3 Office Investors, LLC and Bay Meadows MU3 Residential Investors, LLC; and authorize the Public Works Director to execute the agreement in substantially the form presented.

BACKGROUND:

The Planning Commission approved the application for a modification to a Site Plan and Architectural Review for Bay Meadows MU3 (PA-2020-053) on June 11, 2021. The project consists of a 4-story commercial building with approximately 121,000 square-feet of office space and 5,600 square-feet of ground floor active space along South Delaware Street and a 4-story residential building with 67 dwelling units along West Kyne Street on a 1.5-acre site. Since the project proposes 12 commercial condominiums and 67 residential condominiums and merges the two existing lots, a final map was required as a Condition of Approval. The project was also required to dedicate a pedestrian passage easement as a Condition of Approval to accommodate a public access path through the project site.

In July 2025, the developer filed a final map application with the City in compliance with the Conditions of Approval, Subdivision Map Act, and San Mateo Municipal Code Title 26. The final map includes a dedication for a pedestrian passage easement for public access. The final map was reviewed for accuracy and completeness by the City’s survey and mapping consultant, CSG Consultants. A copy of the final map is included as Attachment 2.

The developer is requesting the final map be approved and recorded prior to the completion of the project’s right-of-way improvements which includes replacing an existing driveway with standard sidewalk, landscaping strip, and curb and restoring other portions of the sidewalk affected by service lateral installations. Government Code Section 66462(a) requires the developer to enter into a subdivision improvement agreement with the City to ensure completion of the work. The associated improvement plans were prepared by the developer’s engineer and are compliant with the City standards, and to the satisfaction of the Public Works Director. The subdivision improvement agreement is included as Attachment 3.

BUDGET IMPACT:

Approval of the final map and subdivision improvement agreement will have no budgetary impact.

ENVIRONMENTAL DETERMINATION:

This action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
