MEETING DATE: December 01, 2025
SUBJECT:

Multi-Jurisdictional Disparate Impact Study with HEART, MOU — Approval RECOMMENDATION:

Authorize the Director of Community Development to sign a Memorandum of Understanding between the City and the Housing Endowment and Regional Trust (HEART) of San Mateo County to participate in a Multi-Jurisdictional Disparate Impact Analysis.

BACKGROUND:

The City of San Mateo has a long history of collaboration and resource sharing on various studies and initiatives as part of the 21 Elements Planning Collaborative (21E). The Housing Endowment and Regional Trust of San Mateo County (HEART), a Joint Powers Authority in San Mateo County, initiated a Multi-Jurisdictional Disparate Impact Analysis (DIA) study to help 21 cities share resources to study, establish and strengthen existing local preference policies for affordable housing.

The City of San Mateo currently has a live/work preference that was established via Resolution 22 on March 2, 2009. The purpose of participating in the DIA is to provide the City with San Mateo-specific information on the fair housing implications of the local preference policy and make recommendations on how the policy can be best applied to achieve the City’s policy goals and conform with State fair housing laws.

The findings of the DIA will inform an updated policy that staff will bring to City Council in 2026 for adoption via Resolution. HEART, serving as the project manager, selected Street Level Advisors as the consultant for this study following after a competitive bidding process and request for proposal (RFP) process. The City of San Mateo, along with the cities of Brisbane, Burlingame, Daly City, Millbrae, Pacifica, and San Bruno have expressed interest in joining the study. The total cost under the MOU is $72,751, with $57,000 to Street Level Advisors and $15,751 to HEART for managing the project. The total cost to the City of San Mateo under this MOU will be $10,393. The study is expected to be completed by February 2026.

BUDGET IMPACT:

The City has sufficient funds in Fund 250 (City Housing Fund) to support the City’s share of costs to participate in the DIA.

ENVIRONMENTAL DETERMINATION:

This agreement is not a project subject to CEQA, because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code Section 21065.) NOTICE PROVIDED:

All meeting noticing requirements were met.
