Clean Water Program Labor Compliance Consultant – Amendment RECOMMENDATION:

Approve Amendment No. 2 to the agreement with TSG Enterprises, Inc. DBA The Solis Group for on-call labor compliance services for the Clean Water Program in an amount not to exceed $50,000, for a total amount of $450,000; and authorize the Public Works Director to execute the amendment in substantially the form presented.

BACKGROUND:

The City of San Mateo Clean Water Program (CWP) is a comprehensive program to upgrade the aging wastewater collection system and the Wastewater Treatment Plant (WWTP) to provide reliable services for years to come. The success of the CWP depends on the completion of several complex construction projects funded by a variety of sources.

State and Federal labor regulations apply to each project based on the scope and funding. To ensure compliance with all applicable laws, the City Council approved an agreement with TSG Enterprises, Inc. DBA The Solis Group, on May 6, 2019, to perform the labor compliance monitoring and reporting for the CWP.

The initial on-call agreement amount was established to provide labor compliance support on the earlier WIFIA-funded construction projects such as WWTP GMP-1, Underground Flow Equalization System, Dale Ave Pump Station Improvements, and Lift Stations Improvement construction packages. Amendment No. 1 was approved on June 7, 2021, for additional support on the remaining WIFIA-funded components of the CWP, including WWTP GMP-2 and GMP-3, Pacific Boulevard Force Main, Delaware Street Sewer Relief, El Camino/Flores Relief Sewers, and El Camino/28th Avenue/Colegrove Relief Sewers.

Construction of the WWTP GMP-3 is approximately 97% complete and in its final stages and construction of the new treatment process facilities is complete. Process seeding, startup, and performance testing is expected to occur in the November 2025 – January 2026 timeframe with the new WWTP anticipated to be in full service by January 2026. The remaining scope of work on the existing WWTP and final completion of miscellaneous sitewide improvements is anticipated to be complete by June 2026.

As a result of the GMP-3 construction contract extension, extension of associated labor compliance services is also necessary. Staff estimates an additional $50,000 should be added to TSG’s on-call agreement to support the monitoring and reporting through final completion of the WWTP GMP-3. The current term of TSG’s on-call agreement is through June 30, 2026.

BUDGET IMPACT:

Sufficient funds are available in the WWTP and Flow Management Upgrade and Expansion Project (46t003) to fund

CITY OF SAN MATEO
Amendment No. 2 to TSG’s on-call agreement for labor compliance services for the CWP.

ENVIRONMENTAL DETERMINATION:

The City prepared a Final Programmatic Environmental Impact Report (Final PEIR) in accordance with the California Environmental Quality Act (CEQA) (SCH No. 2015032006). The PEIR was certified by City Council on June 6, 2016. In accordance with CEQA, the Final PEIR serves as the primary environmental compliance document for implementation of the Clean Water Program. The City prepared an Addendum to the Final PEIR that were approved on July 16, 2018 (Addendum 1) and April 15, 2019 (Addendum 2). This work is within the scope of the project evaluated in the PEIR and Addenda.
