Agenda Number: 12 Section Name: NEW BUSINESS Account Number: 10-1711 File ID: 26-10926 TO: City Council
FROM: Aracelia Esparza, Director of Human Resources
PREPARED BY: Human Resources Department
MEETING DATE: February 23, 2026
SUBJECT:
City Attorney Employment Agreement — Amendment
RECOMMENDATION:
Adopt a Resolution to amend the compensation for the City Attorney and authorize the Mayor to execute an amendment to his employment agreement.
BACKGROUND:
On October 28, 2025, during a City Council Special Meeting, the City Council conducted the annual performance evaluation of the City Attorney. On February 23, 2026, the City Council considered the City Attorney’s performance, which meets or exceeds all expectations. Following discussions between the City Attorney and Council members Lisa Diaz Nash and Danielle Cwirko-Godycki, who was designated as the negotiators for the City, the attached amendment to the employment agreement is proposed for consideration by the City Council. The amendment would increase the City Attorney’s compensation in the amount to be preliminarily determined by the Council in a closed session to be held on February 23, 2026. Consistent with state law, the Council may only take action on the proposed amendment and compensation adjustment in open session.
BUDGET IMPACT:
There are sufficient funds in the City Attorney’s office budget to accommodate a compensation adjustment.
ENVIRONMENTAL DETERMINATION:
This employment agreement amendment and compensation is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
NOTICE PROVIDED
All meeting noticing requirements were met.
