Agenda Number: 9 Section Name: CONSENT CALENDAR Account Number: 10-1311 File ID: 26-10886 TO: City Council
FROM: Alex Khojikian, City Manager
PREPARED BY: City Manager's Office
MEETING DATE: April 20, 2026
SUBJECT:
2nd and El Camino Public Garage License Agreement — Amendment RECOMMENDATION:
Approve a First Amendment to the License Agreement between the City of San Mateo and Sutter Bay Hospitals, dba Mills- Peninsula Medical Center, to clarify the agreement commencement date as July 1, 2025, confirm a thirty (30) day termination provision and authorize the City Manager to execute the amendment.
BACKGROUND:
On June 15, 2025, the City Council approved a license agreement with Sutter Bay Hospitals, dba Mills-Peninsula Medical Center (MPMC), for the use of sixty (60) City-owned parking spaces on the fifth floor of the 2nd Avenue and El Camino Real public garage for hospital staff parking.
Following execution, staff identified the need to clarify two aspects of the agreement: (1) its commencement date, and (2) termination notice. These clarifications do not change the number of parking spaces, or operational intent approved by Council for the license agreement.
The agreement currently states that is binding on the parties on the date of City Council approval, which was June 16, 2025. This update would instead establish the effective date as July 1, 2025. Also, existing language (Section 21) that permits termination on thirty (30) days’ notice would be retained, while contradictory language (in Section 2(A)) that allowed for termination on sixty (60) days’ notice would be removed. All other terms of the agreement would remain in full force and effect.
These changes provide certainty for both the City and MPMC and do not result in any substantive changes to the previously approved agreement. Therefore, staff recommends approval of the First Amendment to the License Agreement.
BUDGET IMPACT:
There is no fiscal impact associated with this amendment.
ENVIRONMENTAL DETERMINATION:
This item is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
