PREPARED BY: Public Works Department
MEETING DATE: June 15, 2026
SUBJECT:

Peninsula Heights Public Improvements — Adoption
RECOMMENDATION:

Adopt a Resolution to accept public improvements in accordance with the Subdivision Improvement Agreements for Peninsula Heights with 2655 CAMPUS POP OWNER, LLC, 2755 CAMPUS POP OWNER, LLC, 2800 CAMPUS POP OWNER, LLC, and 2988 CAMPUS POP OWNER, LLC.

BACKGROUND:

The Peninsula Heights development, under Planning Application PA-2020-012, is a private development project creating a total of 74 single-family residential lots and 216 residential condominiums across the properties of 2655, 2755, 2800, and 2988 Campus Drive (Project).

City Council approved the Peninsula Heights Final Maps in two phases (South and North) and the associated subdivision improvement agreements for each. The first phase, South, is located at 2655 and 2755 Campus Drive, and the final map and subdivision improvement agreement were approved by City Council on February 6, 2023. The second phase, North, is located at 2800 and 2988 Campus Drive, and the final map and subdivision improvement agreement were approved by City Council on April 7, 2025. The subdivision improvement agreements allow for the deferral of the construction of the public improvements, that were required as conditions of approval and the vesting tentative map of the Project, until after the final maps are recorded.

Prior to the commencement of construction and per Section 14 of each subdivision improvement agreement, the subdivider was required to provide the City surety bonds totaling $1,389,549 for the South Phase and $939,000 for the North Phase. After receiving the surety bonds, the subdivider was issued encroachment permits for the construction of the public improvements.

On April 22, 2026, the Public Works Department certified the public improvements were satisfactorily completed and staff recommends that the City Council accepts the improvements pursuant to the Subdivision Improvement Agreements Section 24. Once accepted, the City will assume maintenance responsibilities of all public improvements except for the stormwater treatment measures and sidewalks, which will be maintained by the developer.

BUDGET IMPACT:

The City will assume maintenance responsibilities for all public improvements except for stormwater treatment measures and sidewalks. Ongoing costs for maintenance of the new improvements within the City right-of-way will be funded through the Public Works maintenance budget.
