7 CITY OF SAN MATEO
RESOLUTION NO. __(2026)
APPROVING AN ALTERNATIVE PURCHASING PROCEDURE FOR AN AGREEMENT WITH POLYDYNE, INC. FOR THE SUPPLY OF LIQUID EMULSION POLYMER IN THE AMOUNT OF $548,973.94 WHEREAS, the Wastewater Treatment Plant (WWTP) uses liquid emulsion polymer for the dewatering of biosolids; and
WHEREAS, Polydyne, Inc. provides a custom-blended polymer that has been tested and optimized for the WWTP’s biosolids; and
WHEREAS, Polydyne, Inc. is the sole source provider of the custom-blended polymer; and WHEREAS, retesting of polymer blends from other chemical vendors would be a labor-intensive task, requiring additional performance optimization testing; and WHEREAS, in accordance with Municipal Code section 3.60.050(b), agreements may be awarded without competitive bids if calling for bids would be impracticable, unavailing, or impossible and the City Council sets forth findings designating the reasons; and WHEREAS, City staff recommend approval of the agreement with Polydyne, Inc. for the supply of liquid emulsion polymer.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, HEREBY FINDS and RESOLVES that:
1. This Council action is not a project subject to CEQA, because the purchase of liquid emulsion polymer for continuing WWTP processes is a continuing maintenance activity involving the purchase of supplies (CEQA Guidelines Sections 15378(b)(2).).
2. In accordance with San Mateo Municipal Code Section 3.60.050(b), calling for bids would be impracticable, unavailing, and impossible because:
a) A custom-blended polymer has been tested and optimized for the WWTP’s biosolids; b) Polydyne, Inc. is the only provider of this custom-blended polymer; and c) The retesting of different polymer blends would be labor-intensive, requiring additional optimization.
3. The agreement with Polydyne, Inc., for the supply of liquid emulsion polymer, in an amount not to exceed $548,973.94, with a contingency reserve in the amount of $54,900, is approved.
4. The Public Works Director is authorized to execute the agreement in substantially the form presented on behalf of the City.
