FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: July 20, 2026
SUBJECT:

Public Utility Easement Dedication Acceptance — Adoption RECOMMENDATION:

Adopt a Resolution to accept the grant of public utility easement dedication acceptance in private alley near property located at 31-57 S B St.; and authorize the City Manager to execute the easement dedication in substantially the form presented.

BACKGROUND:

On November 21, 2022, DTSM Donut Delite, LLC (herein referred to as the “Applicant”) submitted a planning application (PA-2022-089) with the Planning Division for a Site Plan and Architectural Review for construction of a new mixed-use building consisting of 41,190 square-feet of retail, commercial, and office uses located at 31-57 South B Street and a Vesting Tentative Map to merge four existing parcels into one (collectively referred to as “Project”) in the City of San Mateo. The planning application was entitled under Resolution No. 5 (2024) by the Planning Commission of the City of San Mateo at a regular meeting held on July 23, 2024.

The Project is currently in the process of obtaining building permits and recording of the Parcel Map. During the building permit review, the Applicant determined that the Project and adjacent properties would benefit from a Public Utility Easement Dedication within the private alley. The private alley is a tenant-in-common and all affected property owners will sign the easement dedication in substantial conformance with Attachment 1. The total easement to be dedicated contains approximately 4,299 square feet by extending 20 feet into the private alley adjacent to the Project property.

BUDGET IMPACT:

All staff costs associated with review and approval of this easement dedication is paid for by the Applicant through permit fees based on the current Master Fee Schedule.

ENVIRONMENTAL DETERMINATION:

The acceptance of this easement dedication is not a project for CEQA because it can be seen with certainty that it will not cause a physical change in the environment. (Public Resources Code 21065.) STRATEGIC PLAN ALIGNMENT:

This plan supports the Economic Development initiative.
