PREPARED BY: Parks and Recreation Department
MEETING DATE: July 20, 2026
SUBJECT:

Youth and Adult Tennis and Pickleball Recreation Programs — Amendment RECOMMENDATION:

Approve Amendment No. 1 with Todd Dissly Athletics, LLC (TDA) to make a one-time payment of $20,171.04 for services already rendered, to increase annual compensation from $300,000 to up to $350,000 annually, with a $25,000 contingency, resulting in the overall six (6) years $2,050,000; and authorize the Director of Parks & Recreation to execute the amendment and change orders in substantially the form presented.

BACKGROUND:

The Parks and Recreation Department contracts with TDA to provide youth and adult tennis classes, and camps. The original agreement, approved on June 6, 2022, established a two-year term with two (2) automatic two-year extensions for a total contract length of up to six years, expiring in 2028. At that time City Council approved the agreement with annual compensation of up to $300,000 and authority for change orders up to $25,000 per year.

Participation in tennis programming and the program enhancement of adding pickleball, has grown significantly since the agreement was executed. Enrollment, number of class offerings, and overall revenue have all increased, resulting in higher payouts to TDA, who is compensated based on a percentage of gross course revenue minus the administrative service fee.

During Fiscal Year 2025–2026, participation in City recreation programs exceeded projections, resulting in instructor service costs surpassing the original annual contract limit of $300,000 and fully consume the $25,000 contingency previously authorized. This resulted in a remaining balance of $20,171.04 owed to TDA for services already rendered.

Amendment No. 1 authorizes a one-time payment of this amount, ensuring the City meets its contractual obligations for FY 2025–26 and establishes a revised not-to-exceed amount of $341,630.70 for that fiscal year.

Amendment No. 1 also increases the annual compensation amount to $350,000 for future fiscal years left in the current contract, while maintaining authority for change orders up to $25,000 annually. This adjustment increases the overall contract maximum from $1,950,000 to $2,050,000 and provides financial capacity to deliver recreation services consistent with community demand.

Annual compensation to TDA has increased due to sustained demand notably from 2023 to current, with an increase of 34% in enrollment.

Year Revenue Payments to TDA Enrollment
FY 22/23 $352,617.09 $256,143.00 1,809
FY 23/24 $307,113.96 $275,862.13 1,640
FY 24/25 $415,854.23 $316,408.93 2,038
FY 25/26 $458,386.18 $346,441.04 2,201

The current agreement compensation split paid to the contractor from total revenue collected is 80 % for fall classes and 75% for spring, summer and winter classes. Total contract payouts to date: $1,194,855.10 This upward trend demonstrates the continued popularity of tennis instruction within the community and aligns with the City's long-term recreation participation goals.

BUDGET IMPACT:

All compensation to the Contractor is covered by course registration fees paid by the participants.

ENVIRONMENTAL DETERMINATION:

This Amendment No. 1 is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
