0 AMENDMENT NO. 1 TO THE AGREEMENT
BETWEEN THE CITY OF SAN MATEO AND
BOSCO OIL, INC. DBA VALLEY OIL COMPANY FOR
DIESEL FUEL PROCUREMENT AND DELIVERY SERVICES
($400,000 [Original Amount] / $319,000 [Amendment No. 1]) This Amendment is made and entered into this day of ______________ by and between the CITY OF SAN MATEO, a municipal corporation existing under the laws of the State of California ("CITY"), and BOSCO OIL, INC. DBA VALLEY OIL COMPANY ("CONTRACTOR").
WHEREAS, CITY and CONTRACTOR entered into an Agreement for diesel fuel procurement and delivery services (“Agreement”) on June 26, 2025; and
WHEREAS, CITY and CONTRACTOR wish to amend the Agreement to increase compensation by $319,000, for a new total Agreement amount of $719,000.
NOW, THEREFORE, the Parties agree as follows:
1. Section 5 – Payment of the Agreement is amended to read:
“Payment shall be made by the CITY only for services rendered and upon submission of a payment request upon completion and CITY approval of the work performed. In consideration for the full performance of the services set forth in Exhibit A, as amended, CITY agrees to pay CONTRACTOR a fee in an amount not to exceed $719,000, in accordance with the rate set forth in Exhibit B, inclusive costs associated with the additional scope of work.”
2. The remaining terms of the Agreement remain in full force and effect. [SIGNATURE PAGE FOLLOWS]
