FROM: Alex Khojikian, City Manager
PREPARED BY: Public Works Department
MEETING DATE: September 22, 2026
SUBJECT:
303 Baldwin Avenue Public Improvements — Adoption
RECOMMENDATION:
Adopt a Resolution to accept public improvements in accordance with the Subdivision Improvement Agreement for 303 Baldwin Avenue with 303 Baldwin LP.
BACKGROUND:
The 303 Baldwin Avenue development, under Planning Application PA-2017-085, is a private development project that created 64 residential condominium units, one commercial condominium unit, one office condominium unit, and three garage condominium units on one lot.
City Council approved the 303 Baldwin Avenue Final Map and the associated subdivision improvement agreement on January 19, 2021. The subdivision improvement agreement allowed for the deferral of the construction of the public improvements, which were required as a condition of approval for the vesting tentative map for the project, until after the final map was recorded.
Prior to the commencement of construction, the subdivider was required to provide surety bonds or other improvement security totaling $2,343,822 per Section 14 of the subdivision improvement agreement. After receiving letters of credit for improvement security, the subdivider was issued encroachment permits for the construction of the public improvements.
On May 29, 2024, the Public Works Department certified the public improvements were satisfactorily completed, and staff recommends that the City Council accepts the improvements pursuant to Section 24 of the Subdivision Improvement Agreement. Once accepted, the City will assume maintenance responsibilities of all public improvements except for the stormwater treatment measures, sidewalks, parklets, benches, trench drains, curb drains, bicycle racks, landscaping, and irrigation which will be maintained by the property owner.
BUDGET IMPACT:
The City will assume maintenance responsibilities for all public improvements except for the stormwater treatment measures, sidewalks, parklets, benches, trench drains, curb drains, bicycle racks, landscaping, and irrigation. Ongoing costs for maintenance of the new improvements within the City right-of-way will be funded through the Public Works maintenance budget.
ENVIRONMENTAL DETERMINATION:
This action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).)
