PREPARED BY: Public Works Department
MEETING DATE: September 22, 2026
SUBJECT:

Storm Drain Easement Dedication Acceptance for Property at 477 9th Avenue — Adoption RECOMMENDATION:

Adopt a Resolution to accept the grant of storm drain easement for public stormwater flow along 9th Avenue on the property located at 477 9th Avenue in substantially the form presented.

BACKGROUND:

The Planning Commission approved the application for a Special Use Permit, Site Plan and Architectural Review, and Site Development Planning Application for 477 9th Avenue (PA-2022-047) on December 12, 2023. The project consists of a fivestory mixed-use building, consisting of 29,207 square-feet of office space and 120 residential apartment units on a 1.6-acre site. Since the site was previously subdivided into 13 commercial condominiums and the new project did not include any condominium units, a reversion to acreage final map was required as a Condition of Approval to eliminate the condominium purpose from the site. The project was also required to dedicate a sidewalk easement as a Condition of Approval to accommodate a wider public sidewalk along the entire project frontage. A reversion to acreage final map, which included the sidewalk easement dedication, was approved by City Council on November 17th, 2025, and recorded with the County of San Mateo on December 22, 2025.

During construction of the project, the developer had to revise the stormwater design to remain in compliance with C.3 stormwater requirements. The revised design directs stormwater runoff from a portion of the Public Right-of-Way on 9th Avenue to a stormwater treatment facility on the project property before discharging to the City‘s storm drain system. A storm drain easement is required since the revised design directs public stormwater flow through private property. In June 2026, the developer filed the grant of storm drain easement with the City in compliance with the Subdivision Map Act and San Mateo Municipal Code Section 26. The easement dedication was reviewed for accuracy and completeness by the City’s survey and mapping consultant, CSG Consultants. Maintenance of the stormwater treatment facility and associated piping will be the responsibility of the property owner. A stormwater treatment facilities maintenance agreement is already required as a condition of approval for the project and the agreement will be executed and recorded prior to occupancy of the project.

BUDGET IMPACT:

All staff costs associated with review and approval of this easement dedication are paid for by the Developer through fees based on the Master Fee Schedule.

ENVIRONMENTAL DETERMINATION:

This action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) On December 12, 2023, the

CITY OF SAN MATEO
Planning Commission determined that the underlying development proposal was exempt pursuant to CEQA Guidelines Section 15332 (Class 32 – In-Fill Development Projects).
