CITY OF SAN MATEO
RESOLUTION NO. ____ (2026)
ACCEPTING THE STORM DRAIN EASEMENT DEDICATION FOR 477 9TH AVENUE, SAN MATEO WHEREAS, the Special Use Permit, Site Plan and Architectural Review, and Site Development Planning Application for 477 9th Avenue (PA-2022-047) was approved by the Planning Commission on December 12, 2023; and
WHEREAS, a reversion to acreage final map was approved by City Council on November 17, 2025 and recorded with the County of San Mateo on December 22, 2025; and WHEREAS, a revision to the stormwater design during the construction phase required the dedication of a storm drain easement; and
WHEREAS, the developer filed a grant of storm drain easement with the City in compliance with the Subdivision Map Act and San Mateo Municipal Code Title 26; and WHEREAS, the grant of storm drain easement is technically correct; and WHEREAS, maintenance of the stormwater treatment facility and associated piping will be the responsibility of the property owner; and
WHEREAS, a stormwater treatment facilities maintenance agreement is required as a condition of approval for the project and will be executed and recorded prior to occupancy of the project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN MATEO, CALIFORNIA, HEREBY RESOLVES that:
1. This action is not a project subject to CEQA, because it is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) On December 12, 2023, the Planning Commission determined that the underlying development proposal was exempt pursuant to CEQA Guidelines Section 15332 (Class 32 – In-Fill Development Projects).
2. The acceptance of the storm drain easement dedication is approved, and the City Manager is authorized to execute the dedication in substantially the form presented.
